(8) The policy covers products and completed operations; <br /> (d) The certificates shall indicate that coverage shall not be canceled unless thirty (30) <br /> days written notice is given to Port (10 days in the event of cancellation arising out <br /> of non - payment of premium). Further, the City agrees to separately notify the Port <br /> in the event coverage is materially altered. <br /> (e) Failure of Coverage. Failure inability or refusal of City to take out and maintain <br /> during the entire term of this Agreement any and all of the insurance herein shall at <br /> the option of Port constitute a breach of this Agreement and justify Pon's <br /> immediate commencement of breach procedures under this Agreement. <br /> (f) Self Insurance. City has the right and option to self - insure the requirements under <br /> this Section 5 upon written notice to Port that City assumes the obligations in the <br /> place and stead of any insurance carrier, any reference to failure to cover <br /> notwithstanding. In the event that City elects to self - insure, City shall provide to <br /> Port a certificate or other evidence of self - insurance acceptable to Port. <br /> 6. Maintenance Responsibilities: <br /> The Parties shall be responsible for the maintenance and repair of Connecting Trail <br /> Improvements on the respective portions of each Party's properties, including prompt <br /> repair of vandalism and prompt removal of graffiti. All Connecting Trail Improvements <br /> on each Party's respective properties shall be kept in a safe and neat condition, normal <br /> wear and tear excepted. <br /> City shall be responsible for the maintenance of the 6' high security /perimeter fence. <br /> 7. Notification: <br /> To request access, or to report maintenance or operations concerns under this Agreement, <br /> City must contact Port's Operations Line Supervisor at (510) 563 -3360 and by e -mail at <br /> linesup@portoakland.com. Port must contact City's Public Works by telephone at (510) <br /> 577 -3440. Port and City staff shall meet at least once annually to discuss maintenance <br /> and operations issues and concerns, and to exchange updated contact information. <br /> 9.
