"Act" means sections 1350 through 1372 of the California Civil Code, as now in effect <br /> and as the same may from time to time be amended. replaced or supplemented. <br /> "Architectural Review Board" or "ARB" means the architectural review board <br /> established pursuant to Section 16.2 hereof. <br /> "Articles" means the Association's Articles of Incorporation, as the same may from time <br /> to time be amended. <br /> "Association" means the 2370 -2374 Marina Boulevard Condominium Homeowners' <br /> Association, a California nonprofit mutual benefit corporation, and its successors and <br /> assigns. <br /> "Association Rules" means the rules and regulations. adopted by the Board from time to <br /> time regulating the use and enjoyment of the Common .reas.) <br /> "Board of Directors" or "Board" means the Board of Directors of the Association. <br /> "Bylaws" means the Association's Bylaws, as the some,ma time to time be <br /> amended. w \\ <br /> "Common Areas" means the leasehold interest inthe entire Project created by the <br /> Common Areas Lease, excepting therefrom aILIJmts as defined inihis Declaration, as <br /> shown on the Condominium Plan. The Common Areas shall include, without limitation. <br /> the Project's structures (except for the Units�the.air space'above such structures, all <br /> bearing walls, columns, floors. roofs, slabs, foundetionscommon stairways and <br /> hallways, reservoirs, tanks. pumps, air.ducts, and other central services equipment, pipes, <br /> ducts, flues, chutes. conduits. wiresS'and other utility installations, wherever located. <br /> servicing more than one Unit (except the outlets thereof'when located within and <br /> servicing only a particular Unit), , la ns, pavement.t`ees. all�other landscaping on the <br /> Land on which the r ject s'structures "are located, parking andstorage spaces, if any, <br /> and the structures ailinan <br /> denclosures of balconies dew private yards and <br /> entryways. \1 c/ <br /> - Condominium - eans,an estate in real property. as defined in sections 783 and 1351(1) <br /> of the California Civil Code,'consistihg.of (i) a Unit: (ii) a Percentage Interest in the <br /> Conunon..Areas; (iii) any vi o - nonexclusiv , �e right of entry, right of possession. <br /> easement or easementts'appurtenant to such-Unit over the Common Areas or other areas <br /> as described in this Declaration'the,Condominium Plan and the deed to the <br /> Condo m�um: and (iv) a <br /> i: the Association. Whenever reference to a <br /> Condomihium is made in this�Declaration. the Condominium Plan. any deed, or <br /> elsewhere, shall be assumed that such reference is made to the Condominium as a <br /> whole, including each of it)component elements. <br /> "Condominium Instruments" means this Declaration, the Articles, and the Bylaws, <br /> together with any supplements, amendments. exhibits. schedules, or certifications thereto. <br /> "Condominium Plan" means the Map for the Condominium Subdivision for the Project <br /> filed on 2011 Volume _ of Maps. Page — in the official records <br /> of the County Recorder of Alameda, California, pursuant to section 1351(e) of the <br /> California Civil Code. A copy of the Condominium Subdivision is attached as Exhibit B. <br /> In the event of any conflict between Exhibit B and the recorded Condominium <br /> Subdivision, the recorded document shall control. <br /> "Convey", when applied to a Condominium. means the due execution of a valid deed to a <br /> Unit by an owner and an assignment of such owner's leasehold interest in the Common <br /> Areas. <br />
