"Current Dollars" means any dollar amount stated herein multiplied by the quotient <br /> obtained by dividing (1) the level of the "National Consumer Price Index for All Urban <br /> Consumers, All Items" (1982 -84 =100) (commonly known as the "CPI -U ") prepared and <br /> published by the United States Department of Labor. Bureau of Labor Statistics, as of the <br /> date of computation by (ii), the level of the CPI -U as of the date of recordation of this <br /> Declaration; provided, however, that should the CPI -U cease to be published, the above - <br /> described computation shall be made using such other successor or reasonably <br /> comparable index as shall be determined by (A) Declarant during the Declarant Control <br /> Period. <br /> "Declarant" means SANTIAGO GUITRON and DELIAGUITRON , as individuals, <br /> and their successors and assigns, if such successors and assigns are duly assigned the <br /> rights of Declarant pursuant to Section 19.2 of this Declaration. <br /> "Declarant Control Period" means the period of time extending from the recordation of <br /> this Declaration to the earliest of (i) that date upon more'than seventy -five percent <br /> (75 %) of the Condominiums which may be included in the Project been conveyed to <br /> owners other than Declarant; (ii) the date two (2) f r <br /> years after the , Condominium has <br /> been conveyed to an owner other than Declarran`; or (iii) the date upon whSch Declarant <br /> notifies the owners that Declarant relinquishests.xights under this Declaration and the <br /> Bylaws to appoint and remove a majority of the'mem o <br /> berrs f'the Board of D or to <br /> exercise powers and responsibilities otherwise assigned ( by the Condominium1nstruments <br /> to the Association. the Board of DireZtors.or any offices of the Association. <br /> "Declaration" means this Declarati �mof Covenants, Conditions, and Restrictions and <br /> includes, as the cont requires, its or supplements. <br /> "Domestic Partner�tneaan_s a•person who (i is a member f a dom partnership <br /> registered with the State of California, "6xcIusrve.Use Common Areas" means those <br /> portions of the Common Are � which are for the exclusive use of the owners of particular <br /> Units in accordance the California Civil Coe, section 1351(1), as described in <br /> A rticle 3- of-this Declaration. <br /> "Identifying- Number" means one o�etters�or numbers included in the <br /> C ndominium Plan,that identify' my on Co in the Project. <br /> "Land means the reakproperty,exclusive of any improvements thereon, as described in <br /> Exhibrt.A "to this Declaration <br /> "Memberea s every person or en ity holding a membership in the Association. <br /> "Mortgage' mans a mortgage or deed of trust encumbering a Condominium or other <br /> portion of the Project. A "First Mortgage" means a Mortgage having priority of security <br /> over all other Mortgages encumbering the same Condominium. <br /> "Mortgagee" includes,the beneficiary under a deed of trust. An "Institutional Mortgagee" <br /> means a Mortgagee that is (i) a bank or savings and loan association or mortgage <br /> company, or other entity chartered or licensed under federal or state laws whose principal <br /> business is lending money on the security of real property or investing in such loans; (ii) <br /> any insurance company; (iii) any private or governmental agency or instrumentality, <br /> including without limitation, the Federal National Mortgage Association and the Federal <br /> Home Loan Mortgage Corporation, engaged in secondary market transactions with <br /> respect to real estate loans; and (iv) Declarant. A "First Mortgage," "First Mortgagee," or <br /> "First Institutional Mortgagee" means the beneficiary of a First Mortgage. <br />
