• <br /> 1. If the design of any site improvement requires encroachments onto neighboring <br /> properties during construction, Applicant shall submit written agreements with that <br /> property owner to the City Engineer, for review and approval, prior to approval of the <br /> building permit. <br /> J. Applicant shall remove any unused driveways or damaged driveways, sidewalk, and curb <br /> and gutter along the full property frontage and shall construct new City standard <br /> driveway, sidewalk, curb and gutter in place of the removed items prior to issuance of a <br /> building permit. <br /> K. Applicant shall comply with the regulations and provisions contained in the City's <br /> Grading Ordinance, the City's Storm Water Pollution Prevention Permit, and the <br /> National Pollutant Discharge Elimination System (NPDES), to the satisfaction of the City <br /> Engineer. More information may be found at www.cleanwaterprogram.org. Rain runoff <br /> from the new roof and any new impervious surfaces must be treated prior to discharge to <br /> the storm drain system or the bay. Treatment must be numerically sized per section C.3 <br /> of the current NPDES permit. <br /> L. Applicant shall comply with the following high standards for sanitation during <br /> construction of improvements. Garbage cans, construction dumpsters, and debris piles <br /> shall be removed on a minimum weekly basis. All food related trash items such as <br /> wrappers, cans, bottles, and food scraps shall be disposed of in closed containers only and <br /> shall be regularly removed from the site. Inspections, conducted as part of the regular <br /> construction compliance, will be conducted to ensure compliance of the Applicant and <br /> contractors with this requirement. <br /> M. Applicant shall mark all on site storm drain inlets "No Dumping, Drains to Bay" prior to <br /> issuance of a certificate of occupancy. <br /> N. Applicant shall provide the number of off street parking spaces specified on Exhibits A <br /> and B of this conditional use permit, and the provided parking spaces shall conform to <br /> City standards. <br /> O. Landscaping shall be designed to minimize irrigation and runoff, promote surface <br /> infiltration where possible, minimize the use of fertilizers and pesticides that can <br /> contribute to stonnwater pollution and incorporate Bay Friendly Landscaping principles. <br /> P. Structures shall be designed to discourage the occurrence and entry of pests into <br /> buildings, thus minimizing the need for pesticides. <br /> Q. If a landscape plan is required as part of a development project application, the plan shall <br /> meet the following conditions related to reduction of pesticide use on the project site: <br /> 1. Where feasible, landscaping shall be designed and operated to treat stomiwater runoff by <br /> incorporating elements that collect, detain, and infiltrate runoff. In areas that provide <br /> detention of water, plants that are tolerant of saturated soil conditions and prolonged <br /> exposure to water shall be specified. <br /> Agreement to Conditions PLN2010 -00071 <br /> February 3, 2011 Page 7 of 15 <br />
