+ _ I <br /> `�- - t. • i • <br /> DEVELOPMENT AGREEMENT <br /> • <br /> This Agreement is entered into as of the k day of <br /> 1985, by and between the City of San Leandro ( "City ") and <br /> United Artists Communications, Inc., a corporation, ( "UACI "). The <br /> City and UACI agree as follows: <br /> Z [ §100] SUBJECT OF AGREEMENT <br /> A. [ §101] Purpose of Agreement <br /> The purpose of this Agreement is to effectuate the settlement of <br /> that certain eminent domain action entitled "City of San Leandro, a <br /> municipal corporation, v. United Artists Communications, Inc., et al." <br /> (No. H- 52626 -9) Alameda County, California. UACI and the City intend <br /> • and acknowledge that this Agreement is a material part of the <br /> consideration for settlement of this action ( "Eminent Domain <br /> Action "). The further purpose of this Agreement is to authorize <br /> development of that certain real property ( "the Subject Property ") of <br /> UACI remaining after the taking pursuant to the Eminent Domain <br /> Action. In executing this Agreement, the City finds and declares <br /> that this Agreement: <br /> (1) Is consistent with the objectives, policies, general <br /> land uses and programs specified in the General Plan <br /> and any applicable specific plan: <br /> (2) Is compatible with the uses authorized in, and the <br /> regulations prescribed for, the land use district in • <br /> which the real property is located; <br /> UACI Dev.
