• r .b. <br /> (3) Is in conformity with public convenience, general <br /> welfare and good land use practice; <br /> (4) Will not be detrimental to the health, safety and <br /> general welfare; <br /> (5) Will not adversely affect the orderly development of <br /> property or the preservation of property values. <br /> B. [ §102] Authorizing Legislation • <br /> The City has been authorized, pursuant to Sections 65864 through <br /> 65869.5 of the Government Code to enter into development agreements <br /> with persons having legal or equitable interest in real property for <br /> the development of such property. Pursuant to Section 65865 of the <br /> Government Code, the City has adopted rules and regulations (Title 5 <br /> Chapter 4 of the San Leandro Administrative Code) establishing <br /> procedures and requirements for consideration of development <br /> agreements. This Agreement has been processed, evaluated and approved <br /> in conformity with such rules and regulations. <br /> C. [ §103] Subject Property <br /> The Subject Property is that real property owned by UACI within <br /> the City of San Leandro lying between Hesperian Boulevard, Fairmont <br /> Drive, Bayfair Way and Bayfair Drive and is more specifically <br /> described in Exhibit A. <br /> D. [ §104] Relationship Of Parties <br /> The City is a municipal corporation operating pursuant to its <br /> freeholder charter and the constitution and general laws of the State <br /> UACI Dev.
