• • <br /> TITLE VII MAPS, BUILDINGS, AND SUBDIVISIONS <br /> Chapter 3 Zoning <br /> Section 7 -3 -552: ALTERATION OF NON- CONFORMING BUILDING. A <br /> non - conforming building, except for a single family or two family <br /> dwelling unit, shall not be altered, enlarged, reconstructed or <br /> otherwise modified if the aggregate cost of such alteration, <br /> enlargement, reconstruction or modification exceeds 50% of the <br /> assessed valuation of the building. The foregoing shall not, <br /> however, prevent the alteration, enlargement, reconstruction or <br /> modification of a buildi na in order to :rake such building conform <br /> to the regulations of this Chapter. <br /> Section. 7 -3 -553: DESTRUCTION OF NON - CONFORMING BUILDING. A <br /> non - conforming building damaged or partially destroyed by fire, <br /> flood, earthquake or similar natural calamity may be reconstructed <br /> if the aggregate cost of such reconstruction does not exceed 50% <br /> of the assessed valuation of the building. In the event that the <br /> non - conforming building so damaged or partially destroyed is an <br /> integral part of a use involving multiple buildings, such building <br /> may be reconstructed if the aggregate cost of such reconstruction <br /> does not exceed 25% of the assessed value of all buildings <br /> involved in such use. Reconstruction shall be commenced within <br /> the period of time specified in Section 7 -3 -554. <br /> Section 7 -3 -534: ABANDONMENT OF NON- CONFORMING USE AND <br /> NON - CONFORMING BUILDING. <br /> (a) A non- conforming use shall be deemed abandoned if such <br /> use ceases for a continuous period of one (1) year where <br /> associated with an enclosed building or for a continuous <br /> period of six (6) months where net associated with an <br /> enclosed building. A non - conforming building shall •re <br /> • deemed abandoned if such building is vacant for a <br /> continuous period of one (1) year. A non - conforming use <br /> and a non- conforming building shall not be reestablished <br /> or reoccupied following abandonment. <br /> (b) In the case of residences only, the one (1) year period <br /> may be suspended by the Zoning Enforcement Officer if <br /> documents are submitted to the City establishing to the <br /> satisfaction of the City Attorney the existence of a <br /> judicial proceeding before a court of competent <br /> jurisdiction, preventing occupation of the residence. <br /> The suspension shall be effective only for the duration <br /> of the' proceeding. <br /> (Legislative History: Ord•.
