4 11 1 4 11 1 <br /> • <br /> Section 7 -3 -533 <br /> thru 7 -3 -535 <br /> TITLE VII :LAPS, BUILDINiGS AND SUBDIVISIONNS <br /> Chapter 3 Zoning <br /> Section 7 -3 -533: VARIANCE - FINDINGS. A variance in whole or in part <br /> or subject to conditions as provided in Section 7 -3 -534 may be granted by the <br /> 3oard of Zoning Adjustments if from the information presented in the application <br /> or at the :eating it appears, and the Beard specifies in its findings the facts <br /> which establish: <br /> (a) That there are exceptional or extrsc :dinary circumstances <br /> applying to the property involved c: to the proposed use of <br /> the property; <br /> (b) That because of such exceptional or extraordinary circum- <br /> stances, the literal enforcement of specified provisions of <br /> { <br /> this Chapter would result in practical difficulty or un- <br /> necessary hardship such as to deprive the applicant of a <br /> substantial property right possessed by other owners of <br /> property in the same class of district; <br /> (c) That the granting of :he variance will not, under the circum- <br /> stances of the particular case, be materially detrimental to <br /> the public welfare or materially injurious to persons or prop- <br /> erty in the vicinity; and <br /> (d) That the results of the granting of :he variance as specified <br /> will be in harmony with the general purposes of :he toning <br /> • ordinance. <br /> (Ord. :;o. 73 -1, Jan. 3, 1973) <br /> Sect'_c- 7 -3 -534: VARIANCE - CONDITIONS. In granting a variance, the <br /> character and extent :hereof shall be specified. A variance may be made con- <br /> ditional and it may be made valid for a specified term period. Once any por- <br /> tion of a variance is utilized all such conditions and specifications shall <br /> be immediately operative, and the violation of any of then shall constitute <br /> a violation of :his ordinance. <br /> Section 7 -3 -535: VARIANCE - AMENDMENT OF APPLICATION. If it appears <br /> at the hearing chat a variance differing from the specific variance sought <br /> could properly be granted under the provisions of this Chapter, the applicant <br /> may then and there offer co amend the application, and the Board ray, if it <br /> finds that the amended application falls within the scope of the notice of <br /> hearing, accept and act upon :he amended application wi.chou :,further publi- <br /> cation.
