TITLE VII MAPS, BUILDINGS AND SUBDIVISIONS <br /> Chapter 3 Zoning <br /> Section 7 -3 -648: CONDITIONAL USES - CONTINUANCE. - Wherever a use <br /> classified and listed herein as a conditional use in the district <br /> • <br /> lawfully exists on the effective date of this Chapter, such use, as <br /> long as it is not.enlarged, increased or expanded to occupy a greater <br /> area of space or property shall be deemed to be an authorized <br /> conditional use without further action by the Board of Zoning <br /> Adjustments. Whenever any such use, or any use hereafter authorized <br /> as a conditonal use, is abandoned or discontinued for one (1) year, <br /> such use shall not be re- established unless it is authorized under new <br /> proceedings as provided in this Chapter. (Legislative History: <br /> Ord. No. 83 -20, 8/1/83; Ord. No. 64 -49, 10/5/64) <br /> Section 7 -3 -649: CONDOMINIUM - CONDITIONAL USE. Condominium <br /> ownership and development of property is permitted in any district <br /> except the R -1 and 0 Districts for uses allowable within the district <br /> in which the condominium development is 'proposed, subject to the <br /> obtaining in each instance of conditional use approval; provided, that <br /> all structures constructed in conjunction with such condominium <br /> development shall comply with all requirements of the district wherein <br /> located. The word "structures" as used herein shall _roan the building <br /> or buildings housing the condominium development without reference to <br /> ownership of portions thereof. Condominium ownership or development <br /> of the air space of a lot or building site shall not be construed as <br /> reducing in dimension or area such lot or building site. (Ord. No. <br /> 74 -31, 6/10/74) <br /> Section 7 -3- 649.1: CONDOMINIUM- CRITERIA FOR APPROVAL. The following <br /> policies, criteria and findings shall govern the evaluation and <br /> conditional approval of applications for approval of construction and <br /> development of condominiums. <br /> (a) Every application shall be specifically analyzed for its <br /> apparent appeal to families with children. This analysis <br /> shall take into consideration at least the following <br /> factors: number of bedrooms, density, cost and the <br /> availability of open space suitable for development as child <br /> play areas where there is a reasonble likelihood of a <br /> significant increase in the number of children over time. <br /> (b) Provisions for assignment of parking spaces to individual <br /> condominium owners, provisions for availability for visitor <br /> use, and existing parking problems apparently generated by <br /> the development shall be analyzed in detail for each <br /> application in order to determine whether or not additional <br /> parking shall be required. <br /> • . 8/8/83 <br /> 127 -1 <br />
