IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2011- <br />RESOLUTION VACATING PORTIONS OF THE PUBLIC RIGHT -OF -WAY OF EDEN <br />ROAD AND DAVIS STREET (AT 3000 DAVIS STREET) <br />Recitals <br />The City Council of the City of San Leandro does RESOLVE as follows: <br />That the City Council hereby elects to proceed under the provisions of Part 3 Public <br />Streets, Highways, and Service Easements Vacation, Division 9, Change of Grade and Vacation <br />of the California Streets and Highways Code. <br />WHEREAS, portions of the public right -of -way to be vacated by this resolution are <br />located along Eden Road and Davis Street, public streets in the City of San Leandro, Alameda, <br />County, California, officially known and designated as such. The portion of the street so <br />proposed to be vacated is described in Parcel Map 10036, attached hereto, and made a part <br />hereof; and <br />WHEREAS, the portions of the public right -of -way of Eden Road and Davis Street are <br />required for street or utility purposes and therefore are excess right -of -way of streets required for <br />utility purposes and there are in -place public utility facilities that are in use and; <br />WHEREAS, the proposed vacation has been found to be categorically exempt from the <br />California Environmental Quality Act (CEQA) requirements in accordance with CEQA Section <br />15061, Subsection (b) (3); and <br />WHEREAS, said vacation is made under Section 8340, of the California Streets and <br />Highways Code. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That the City Council hereby orders the vacation of the herein above <br />described portion of public right -of -way. <br />2. That the City Clerk shall cause a certified copy of this resolution to be recorded in <br />the Office of the Recorder of Alameda County, California, immediately upon its <br />adoption. <br />3. That from and after the date of recordation of this resolution, said portions of <br />right -of -way vacated no longer constitute a public right -of -way. <br />
