TN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2011-117 RESOLUTION VACATING PORTIONS OF THE PUBLIC RIGHT -OF -WAY OF EDEN ROAD AND DAVIS STREET (AT 3000 DAVIS STREET) Recitals The City Council of the City of San Leandro does RESOLVE as follows: That the City Council hereby elects to proceed under the provisions of Part 3 Public Streets, Highways, and Service Easements Vacation, Division 9, Change of Grade and Vacation of the California Streets and Highways Code. WHEREAS, portions of the public right -of -way to be vacated by this resolution are located along Eden Road and Davis Street, public streets in the City of San Leandro, Alameda, County, California, officially known and designated as such. The portion of the street so proposed to be vacated is described in Parcel Map 10036, attached hereto, and made a part hereof; and WHEREAS, the portions of the public right -of -way of Eden Road and Davis Street are required for street or utility purposes and therefore are excess right -of -way of streets required for utility purposes and there are in -place public utility facilities that are in use; and WHEREAS, the proposed vacation has been found to be categorically exempt from the California Environmental Quality Act (CEQA) requirements in accordance with CEQA Section 15061, Subsection (b) (3); and WHEREAS, said vacation is made under Section 8340, of the California Streets and Highways Code. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That the City Council hereby orders the vacation of the herein above described portion of public right -of -way. 2. That the City Clerk shall cause a certified copy of this resolution to be recorded in the Office of the Recorder of Alameda County, California, immediately upon its adoption. 3. That from and after the date of recordation of this resolution, said portions of right -of -way vacated no longer constitute a public right -of -way.
