IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2011 -101 RESOLUTION OPPOSING LEGISLATION IMPEDING LOCAL GOVERNMENTS OR EMPLOYEE LABOR ORGANIZATIONS IN COLLECTIVE BARGAINING FOR EMPLOYEE BENEFITS OR WORKING CONDITIONS WHEREAS, the rights of workers to join together and form worker organizations is a fundamental human right, protected by the Wagner Act of 1935 and the Meyers - Milias -Brown Act of 1968; and WHEREAS, uniform and orderly methods of communication between employees and the public agencies by which they are employed serve to protect the rights of both the employees and the employers; and WHEREAS, while it is recognized that public employee pensions are placing a significant fiscal burden on communities, any changes to those pensions must be negotiated through good faith collective bargaining between employees and employers; and WHEREAS, local control of benefits must remain a matter of local determination, and control of such benefits should not be legislated by the state or federal government; and WHEREAS, in February 2011 California State Assemblyman Allan Mansoor, from Orange County, introduced Assembly Bill 961 that would amend existing law and exclude matters relating to pension benefits from the scope of representation of public employees by recognized employee organizations, and would thereby prohibit these employee organizations from negotiating pension benefits with public employers; and WHEREAS, on May 4, 2011 the Assembly Committee on Public Employees, Retirement and Social Security (PERSS) failed to pass AB 961, however, reconsideration was granted which may result in the bill again being considered by the legislature in 2012. NOW, THEREFORE, the City Council of the City of San Leandro does hereby RESOLVE to oppose any current or future state or federal legislation which would remove or hinder the rights of workers or worker organizations and employers to bargain collectively for any worker benefits, including pension benefits, or working conditions.
