IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011 -101 <br /> RESOLUTION OPPOSING LEGISLATION IMPEDING LOCAL GOVERNMENTS OR <br /> EMPLOYEE LABOR ORGANIZATIONS IN COLLECTIVE BARGAINING FOR EMPLOYEE <br /> BENEFITS OR WORKING CONDITIONS <br /> WHEREAS, the rights of workers to join together and form worker organizations is a <br /> fundamental human right, protected by the Wagner Act of 1935 and the Meyers - Milias -Brown Act <br /> of 1968; and <br /> WHEREAS, uniform and orderly methods of communication between employees and the <br /> public agencies by which they are employed serve to protect the rights of both the employees and <br /> the employers; and <br /> WHEREAS, while it is recognized that public employee pensions are placing a significant <br /> fiscal burden on communities, any changes to those pensions must be negotiated through good <br /> faith collective bargaining between employees and employers; and <br /> WHEREAS, local control of benefits must remain a matter of local determination, and <br /> control of such benefits should not be legislated by the state or federal government; and <br /> WHEREAS, in February 2011 California State Assemblyman Allan Mansoor, from <br /> Orange County, introduced Assembly Bill 961 that would amend existing law and exclude matters <br /> relating to pension benefits from the scope of representation of public employees by recognized <br /> employee organizations, and would thereby prohibit these employee organizations from <br /> negotiating pension benefits with public employers; and <br /> WHEREAS, on May 4, 2011 the Assembly Committee on Public Employees, Retirement <br /> and Social Security (PERSS) failed to pass AB 961, however, reconsideration was granted which <br /> may result in the bill again being considered by the legislature in 2012. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does hereby <br /> RESOLVE to oppose any current or future state or federal legislation which would remove or <br /> hinder the rights of workers or worker organizations and employers to bargain collectively for any <br /> worker benefits, including pension benefits, or working conditions. <br /> Introduced by Councilmember Starosciak and passed and adopted this 6th day of June, <br /> 2011 by the following called vote: <br />
