CITY OF SAN LEANDRO <br /> APPROVED AND <br /> STAFF REPORT FORWARDED <br /> TO CITY COUNCIL <br /> DATE: June 6, 2011 <br /> Stephen Holliste <br /> TO: Stephen Hollister, City Manager City Manager <br /> FROM: Lianne Marshall, Assistant City Manager � <br /> BY: Kathy Omelas, Community Relations Representative <br /> SUBJECT PROJECT/PROJECT DESCRIPTION: � <br /> RESOLUTION OPPOSING LEGISLATION IMPEDING LOCAL GOVERNMENTS OR <br /> EMPLOYEE LABOR ORGANIZATIONS IN COLLECTIVE BARGAINING FOR <br /> EMPLOYEE BENEFITS OR WORKING CONDITIONS <br /> SUMMARY AND RECOMMENDATION <br /> It is recommended a resolution be adopted to declare the City's opposition to any legislation <br /> which would impede the City and its employee organizations in negotiating employee benefits or <br /> working conditions. <br /> BACKGROUND <br /> Analysis <br /> At the March 21, 2011 City Council meeting, a resident asked that the City Council adopt a <br /> resolution opposing legislation being considered in a number of other states which would <br /> eliminate collective bargaining, as well as opposing California Assembly Bill 961, which, if <br /> approved by the California legislature, would prohibit employee organizations from negotiating <br /> pension benefits with public employers. <br /> The matter was referred to the City Council Rules and Communications Committee and was <br /> discussed at its May 5 meeting. Consensus of the Committee was that it would not be <br /> appropriate for the City Council to take a position on matters in other states, but that a resolution <br /> opposing any California or federal legislation which would impede the rights of employee <br /> organizations to negotiate employee benefits in good faith should be considered. <br /> Staff returned to the Committee at its May 26 meeting with a drafted resolution for <br /> consideration. This resolution stated that the City Council opposes any current or future state or <br /> federal legislation which would remove or hinder the rights of workers or worker organizations <br /> and employers to bargain collectively for any worker benefits, including pensions, or working <br /> conditions. <br /> • <br />
