Marina Blvd Street Rehab <br />Award of Contract 2 July 5, 2011 <br />The second lowest bidder, Gallagher & Burk, submitted a timely bid protest challenging <br />Redgwick Construction Company's bid based on an omission in the bid forms, which thereby <br />rendered Redgwick's bid non - responsive. Redgwick did not submit prices for Bid Item 40, <br />Potholing, in the bid's Contract Price Schedule. City staff, with guidance from the City <br />Attorney's Office, reviewed the bid protest, Redgwick's bid, and related correspondence from <br />both contractors and determined that Redgwick Construction's bid was non - responsive based on <br />the submission of an incomplete Contract Price Schedule. Gallagher & Burk's bid proposal of <br />$1,279,866.00 was thus determined to be the lowest responsive bid. <br />The project will: 1) rehabilitate the road pavement; 2) replace outdated curb ramps within the <br />project limits to meet current Americans with Disabilities Act (ADA) standards; 3) repair <br />damaged sidewalk, curb and gutter within the project area; 4) replace brick sanitary sewer <br />manholes with City- standard concrete manholes; 5) construct several new sanitary sewer <br />manholes to facilitate better maintenance; and 6) replace the traffic loops at the <br />Marina/Teagarden and Marina/Alvarado intersections with a video traffic detection system. <br />Previous City Council Actions <br />• On September 7, 2010, by Resolution No. 2010 -109, the City Council authorized the filing of <br />an application for funding under the CMA Block Grant Program, committing the necessary <br />non - federal matching funds, and assuring completion of the project <br />• On September 7, 2010, by Resolution No. 2010 -110, the City Council authorized the <br />appropriation of $807,000 of CMA Block Grant Program funds for the Marina Boulevard <br />Street Rehabilitation Project <br />• On May 2, 2011, by Resolution No. 2011 -085, the City Council approved the plans and <br />specifications for the subject project and authorized the calling for bids <br />Applicable General Plan Policy <br />This action is consistent with Streets and Highways Goal No. 16 of the General Plan and Action <br />Item 16.03 -A: Funding for Maintenance. <br />Code Compliance Review <br />Caltrans Local Assistance has deemed the project a Categorical Exclusion under the National <br />Environmental Policy Act. <br />Fiscal Impact <br />The total construction cost including contingency and construction management is estimated to <br />be $1,470,495.90 as follows: <br />Construction Contract $1,279,866.00 <br />10% Construction Contingencies $127,086.60 <br />Construction Management and Administration $63,543.30 <br />
