• i <br /> Airport Committee <br /> Page 2 <br /> June 24, 2003 <br /> To quote from the Settlement Agreement Page 4, Paragraph 2(a) <br /> "City's Management of program: <br /> The City shall be solely responsible for management and <br /> implementation of the City's Residential Airport noise program " <br /> It must be a mandatory provision that whoever is selected should have <br /> had no past involvement with The Port. Accordingly, Jones Payne or <br /> Carlett, Skaer & De Voto would be an excellent choice. <br /> During the course of the interview, several issues kept repeating: <br /> 1) How do you administer and make selection of 200 homes when <br /> there are approximately 1,200 possibly affected? <br /> 2) How can an objective insulation program be designed without a <br /> corresponding sound study furnished by a consultant other than <br /> one supplied by the Port? (The agreement signed in 2000 does not <br /> allow a sound study). <br /> 3) One consultant referenced airport noise being reflected off 880 <br /> freeway and Walmart sound walls and impacting homes in the <br /> area. <br /> 4) Changes to settlement agreement to reflect what will be required to <br /> provide a post construction interior noise level not to exceed CNEL <br /> 45 db. <br /> 5) Are the conditions of the agreement of 2000 cast in stone? <br /> Can/Will the agreement be amended at the discretion of the Port? <br /> 6) No mention in the Settlement Agreement concerning South Field <br /> noise mitigation. <br /> In conclusion, the Settlement Agreement signed in November of 2000 <br /> leaves much to be desired. The residents of West San Leandro must now <br /> deal with an insulation program that will require scrutiny from all <br /> concerned. A quick fix is not the answer and a comprehensive noise <br /> mitigation program is most necessary to bring relief to residents <br /> impacted by noise from the Oakland Airport. In other words, a <br /> comprehensive program would include a complete evaluation of airport <br /> noise and would be the responsibility of the insulation consultant. <br />
