Enforceable Obligation Payment Schedule 3 July 18, 2011 <br />prior to the effective date of AB xl 26. Payments by months are estimates, and the actual timing of <br />payments may vary. <br />Impact of the Alternative Voluntary Redevelopment Program <br />AB xl 27, passed concurrently with AB x1 26, allows redevelopment agencies to be exempted <br />from elimination if they agree to make "voluntary" annual payments. To opt in to this program, <br />agencies must pass an ordinance prior to October 1, 2011 (adoption of the ordinance can be <br />delayed until November 1 if an agency adopts a resolution of intent prior to October 1). City <br />Council consideration of the Alternative Voluntary program is planned for September 6, 2011. <br />If the San Leandro Redevelopment Agency did not opt in to the Alternative Voluntary program, all <br />operations would cease on October 1, 2011 and only Enforecable Obligations could be paid going <br />forward. If the Agency elects to participate in the Alternative Voluntary program, normal <br />operations would resume upon adoption of the ordinance and payments would be due to the <br />County Auditor each January 15 and May 15. <br />If the Agency ultimately opts in to the Alternative Voluntary program, staff believes that the items <br />included on the Enforceable Obligation Payment Schedule will have no impact on Agency <br />operations or funding authority. So long as funding is available, the Agency will be able to fund <br />operations under the same set of rules that were in place prior to June 29, 2011. Payments for <br />services or programs that are not on Enforceable Obligation Payment Schedule would be <br />permissable. <br />Fiscal Impact <br />None. Although the Enforceable Obligation Payment Schedule outlines the details of several <br />financial obligations, the Schedule does not have a material impact on any amounts owed. <br />Attachments <br />Enforceable Obligation Payment Schedule. <br />CONCLUSION <br />Staff recommends that the Redevelopment Agency approve a resolution adopting an Enforceable <br />Obligation Payment Schedule pursuant to Section 34169 of the State of California Health and <br />Safety Code. <br />G: \OBD\Files RDA\Administration & Budget\Enforceable Obligation Schedule \Staff Report EOPS 7 -18 -1 l .doc <br />
