Appeal of the BZA Approval of PLN2011-00014 <br />2 <br />July 18, 2011 <br />Boulevard near the intersection of East Merle Court. Surrounding properties to the north, east <br />and west are all zoned RS Residential Single -Family District, and are developed accordingly. <br />Immediately across the street to the south, is All Saints Episcopal Church, and directly next to <br />that on the east, Roosevelt Elementary School. See Attachment #2. <br />• The property consists of 4,800 square feet in area where 5,000 square -feet is the standard for RS <br />Districts, and also has a substandard width of 40 feet where 50 feet is the standard. Both the <br />substandard lot size and lot width are not untypical for the Broadmoor Neighborhood. <br />• The property is currently developed with a single -story single-family home of approximately <br />1,074 square feet, and a detached one -car garage. <br />• Two-story additions are permitted in the RS District subject to compliance with applicable <br />development requirements and approval of Minor Site Plan Review (Zoning Code Section 2- <br />580) by the Zoning Enforcement Official (ZEO). <br />• In April 2011, the ZEO approved the applicant's Minor Site Plan Review. Soon thereafter in <br />April, an appeal of the ZEO's Minor Site Plan Review was filed to the Board of Zoning <br />Adjustments (BZA) by an adjacent neighbor, Harry Metaxas, on the grounds that the project <br />does not meet the standards of Zoning Code Section 2-580.H <br />• On June 2, 2011, the BZA affirmed, by a vote of 5 ayes, 1 no and 1 abstention, the ZEO's <br />original approval and denied the appeal. (See Attachment #3, draft minutes from the June 2nd <br />BZA meeting). <br />• On June 16, 2011, the BZA's decision affirming the ZEO's original approval was appealed to <br />the City Council citing the same grounds as the original appeal and further asserting that BZA's <br />decision constitutes an abuse of discretion (see Attachment 41). <br />Current City Council Policy <br />Not applicable <br />Previous City Council Action <br />Not applicable <br />City Council Committee Review and Action <br />Not applicable <br />Applicable General Plan Policy <br />The subject site is designated Low Density Residential in the City of San Leandro General Plan, <br />which corresponds with the RS Residential Single -Family zoning designation. <br />
