June 16, 2011 <br />City of San Leandro <br />City Clerk's Office <br />835 E. 14th Street <br />San Leandro, CA 94577 <br />Re: PLN2011-00012, 908 Dowling Blvd. <br />Board of Zoning Adjustments Decision — Request for Appeal <br />The grounds upon which this appeal is filed are: <br />1.The staff failed to follow the requirements of applicable ordinances; specifically, Article 5, Section 2- <br />580 which clearly states that an addition must substantially comply with 4 specific standards <br />(paragraph H # 1-4). <br />2) The staffs decision constituted an abuse of discretion. <br />3) The review board failed to follow the requirements of applicable ordinances; Article 5, Section 2-580 <br />4) The review board decision constituted an abuse of discretion. <br />5) The review board's decision reflects an abandonment of its responsibilities and an admitted <br />abdication of its purpose and function. <br />The City of San Leandro has a long established zoning policy of Residential Site Plan Review for 2 - <br />story construction in place for the protection of all San Leandro residents. These standards are clearly <br />supplemental to the basic Zoning Ordinance, yet the staff and Board of Zoning Adjustments are not <br />administering those standards in a consistent and fair manner The City has a responsibility to enforce <br />its own regulations to protect the rights of all its constituents. The City staff failed to enforce the <br />requirements of the ordinance approving the proposal, notwithstanding, the failure to mitigate impact as <br />required.
