' 2011 and ending on , 2016, at a total rental of <br />Thirty Six Thousand Dollars ($36,000.00), payable in monthly installments of Six Hundred <br />Dollars ($600) in advance in cash to the Lessor at the Finance Office, City of San Leandro, 835 <br />E. 14 Street, San Leandro, CA 94577, (510) 577 -3381, starting on , 2011, <br />and on or before the 1 St day of each month thereafter. Receipt is hereby acknowledged by Lessor <br />of the sum of Twelve Hundred Dollars ($1,200.00) from the Lessee in payment for the first and <br />last months' rental under this Lease. <br />Upon expiration of the term, and Lessee's exercise of the option to renew for an <br />additional five years, the rent amount due shall be subject to an automatic increase of 10 %. In <br />addition, each year of the renewal term shall also be subject to an automatic 3% rent increase <br />year on year. There shall be no holding over upon the expiration of the initial lease term. <br />Lessee's exercise of the option to renew must be in writing forty -five (45) days in advance of the <br />expiration of the initial lease term. <br />3. Permitted Uses The Leased Premises shall be used during the tenancy hereof <br />exclusively for the following: screened outdoor storage of construction materials and vehicle <br />parking. Any change in this use must be approved by the Lessor in advance and in writing. <br />Leasee shall comply with City ordinances, policies and regulations. All improvements shall be in <br />accordance with the City's Design Standards, Specifications and Standard Plans unless otherwise <br />specifically approved by the City Engineer. No work shall be conducted within the public right - <br />of -way. <br />4. Improvements. All fencing and gates shall be screened with fabric fence screen <br />which shall be installed prior to any outdoor storage activities. All fencing and screening at the <br />site shall be structurally sound, graffiti -free and well- maintained at all times. Razor wire shall not <br />be installed on any fence or gate on the site. <br />Prior to occupancy of the site, the applicant shall submit for the review of the City of San <br />Leandro Community Development Director precise details of all signage proposed for the site. <br />Said details shall include but are not limited to location, color, copy and size (dimensions) of the <br />signs. No temporary or unauthorized signs, including but not limited to banners, balloons, <br />streamers and pennants shall be placed on the property. <br />No improvements shall be placed in, on, or upon the Leased Premises, without the prior written <br />consent and approval of Lessor, under penalty of forfeiture of this Lease and the payment of <br />damages by Lessee. <br />5. Hazardous Materials No storage of materials deemed by the Lessor to be a <br />potential fire or other toxic hazard will be permitted, and the operation and maintenance of the <br />Leased Premises will be subject to regulation by the Lessor to protect against fire or other hazard <br />impairing the use, safety, and appearance of the overpass. The occupancy and use of the Leased <br />Premises shall not be such as will permit hazardous or unreasonably objectionable smoke, fumes, <br />vapors or odors to rise above the grade line of the overpass. <br />2 <br />
