• <br /> Medical Marijuana Moratorium 4 September 6, 2011 <br /> An Interim Urgency Ordinance (Ordinance 2010 -012) was enacted by the City Council at its <br /> October 4, 2010 meeting. The moratorium was extended to September 30, 2011 on November <br /> 15, 2010. <br /> City Council Committee Review and Action <br /> Not Applicable. <br /> Applicable General Plan Policy <br /> Not Applicable. <br /> Permits and /or Variances Granted <br /> Not Applicable. <br /> Environmental Review <br /> The extension of this moratorium is exempt from environmental review under the California <br /> Environmental Quality Act (CEQA) pursuant to Public Resources Code section 21065 based on <br /> the finding that this ordinance is not a "project" within the meaning of Section 15378 of the State <br /> CEQA Guidelines, because it has no potential for resulting in physical change in the <br /> environment directly or ultimately. <br /> Code Compliance Review <br /> Not Applicable. <br /> Board /Commission Findings <br /> Not applicable. <br /> Summary Of Public Outreach Efforts <br /> A notice of public hearing was published in the Daily Review. <br /> Fiscal Impact <br /> Not applicable. <br /> Attachments <br /> None. <br /> CONCLUSION <br /> Extension of the interim urgency ordinance would allow staff time to present to the City Council <br /> additional information and provide direction to staff. The next steps would be to hold a work <br /> session to present detailed information regarding the legal issues related to this matter, potential <br /> impacts to public health, safety and welfare, and to discuss whether these facilities would be <br /> appropriate land uses and businesses within and for the City. The City Council can then provide <br /> direction to staff. Therefore, staff recommends that the City Council: <br /> 1) ACCEPT THE WRITTEN REPORT, as required by Government Code 65858(d), <br /> Describing the Measures Taken to Alleviate the Conditions Which Led to the Adoption of <br /> Ordinance No. 2010 -02; and <br /> • <br />
