Airport Noise Insulation Approve Amendment 5 September 19, 2011 <br />of Contract and Change Order <br />• September 18, 2006: Acceptance for work on the Introductory Phase of the Airport Noise <br />Insulation Program and the filing of a Notice of Completion for said work. <br />• May 7, 2007: Approval to amend contract with G.E. Chen Construction, Inc., for Contractor <br />Services related to Phase 1 of a Residential Airport Noise Insulation Program. <br />• December 8, 2008: Approval to amend contract with C.Kell -Smith & Associates, for <br />Contractual Services related to Phase 1 of a Residential Airport Noise Insulation Program. <br />• March 16, 2009: Acceptance for work on Phase 1 of the Airport Noise Insulation Program <br />and the filing of a Notice of Completion for said work. <br />City Council Committee Review and Action <br />The City Council Airport Committee on September 9, 2011 received a report on how the <br />program will proceed should the City Council approve these actions. <br />Summary of Public Outreach Efforts <br />C. Kell -Smith &Associates has been sharing with homeowners on the waiting list the suspended <br />status of the project and the information that the City and Port have been working toward <br />resolution and resumption of the Program. <br />Fiscal Impact <br />Funding for this program will be fully provided by the Port under the terms of the Settlement <br />Agreement. The estimated total cost of the project will be approximately $9,000,000 when all <br />phases are completed. <br />Budget Authority <br />Authorization of appropriation of funds from the Port of Oakland to the City of San Leandro in <br />the amount of $5,054 071, Account Number 210 -42 -102. <br />'roe ames H O'Leary, Interim Finance Director <br />CONCLUSION <br />Staff recommends: <br />• Amendment of contract with C.Kell -Smith & Associates, authorizing the Term of <br />Agreement extension; <br />• Amendment of the contract with G.E. Chen Construction, Inc., authorizing the inclusion <br />of Phases 2 and 3 and approval of change order to increase the original contract amount <br />by $2,403,991; <br />• Authorize City Manager or Designee to expend funds, in an amount not to exceed <br />$475,538, for possible change orders related to increased costs due to changes in original <br />plans and specifications, as well as, federal regulations in hazmat sampling and <br />abatement; <br />• Authorization of appropriation of funds from the Port of Oakland to the City of San <br />Leandro in the amount of $5,054,071. <br />1710817.1 <br />
