Pio Roda, Assistant City Attorney <br />SUBJECT PROJECT /PROJECT DESCRIPTION: <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />Lianne Marshall <br />Interim City Manager <br />A RESOLUTION AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO MAIL A <br />NOTICE OF THE PROPOSED CHANGE IN PURPOSE OF PREVIOUSLY APPROVED <br />SEWER AND WASTEWATER TREATMENT RATE INCREASES; TO SET THE <br />MINIMUM 45 DAY PROTEST PERIOD; AND TO SET THE DATE, TIME AND <br />LOCATION FOR A PUBLIC HEARING TO RECEIVE WRITTEN PROTESTS TO THE <br />PROPOSED CHANGE IN PURPOSE OF PREVIOUSLY APPROVED SEWER AND <br />WASTEWATER TREATMENT RATE INCREASES TO FUND REIMBURSEMENT TO <br />RATE PAYERS OF THE COSTS TO RECONNECT PRIVATE SEWER LATERALS WHEN <br />THE CITY DETERMINES THAT IT IS IN THE BEST INTEREST OF PUBLIC HEALTH <br />AND SAFETY TO CONSTRUCT OR RECONFIGURE CITY SEWER MAINS, IN <br />ACCORDANCE WITH THE REQUIREMENTS OF PROPOSITION 218 <br />SUMMARY AND RECOMMENDATION <br />In accordance with the requirements of Proposition 218, staff recommends that the City Council <br />approve a resolution that: <br />• Authorizes staff to mail to all property owners served by the City's sanitary sewer system <br />notice of a proposed change in the purpose of previously approved sewer and wastewater <br />treatment rate increases, and of a public hearing to receive and count protests to the re- <br />purposing of such rate increases; <br />• Sets October 5, 2011 to November 21, 2011 as the protest period; and <br />• Sets November 21, 2011, 7:00 p.m. (or as soon thereafter) at San Leandro City Hall as <br />the date, time and place for a public hearing to receive and count the protests to the <br />proposed change. <br />BACKGROUND <br />On June 20, 2011, the City Council was presented with several options for how to address <br />reconnecting private sewer laterals to the City's sewerage system when part of that system had to <br />be relocated or reconstructed by the City. After the presentation, the City Council decided the <br />City should pay for reconnecting private sewer laterals in the particular situation where the City <br />determines that it is necessary to relocate or construct a new City maintained sewer main.
