EXHIBIT B <br />HOLD HARMLESS <br />HOLD HARMLESS Lessee hereby agrees to, and shall, hold the Lessor, its elective and <br />appointive boards, commissions, officers, agents and employees harmless from any and all <br />liabilities and claims for damages for bodily and personal injury, including death, as well as <br />from claims for property damage, including theft, that may arise from Lessee or Lessee's <br />contractors', subcontractors', agents' or employees' operations or services rendered, whether <br />such operations or services be by Lessee or by any of Lessee's contractors, subcontractors, or <br />by any one or more persons directly or indirectly employed by, or acting as agent for, Lessee or <br />any of Lessee's contractors or subcontractors, Lessee agrees to, and shall, defend the Lessor <br />and its elective and appointive boards, commissions, officers, agents and employees from any <br />suits or actions at law or in equity for damages caused, or alleged to have been caused, by <br />reason of any of the aforesaid operations and services provided as follows: <br />1. That Lessor does not, and shall not, waive any rights against Lessee that it may have <br />by reason of the aforesaid hold harmless agreement, because of the acceptance by <br />Lessor, or the deposit with the Lessor by Lessee or any of the insurance policies <br />described in these provisions. <br />2. That the aforesaid hold harmless agreement by Lessee shall apply to all damages and <br />claims for damages of every kind suffered, or alleged to have been suffered, by <br />reason of any of the aforesaid operations referred to in the Lessor's active negligence <br />or is caused by the Lessor's passive negligence and without any negligence of Lessee <br />and whether or not such insurance policies have been determined to be applicable to <br />any of such damages or claims for damages. <br />8 <br />
