for Tenant or any such other person or otherwise arising out of <br />or resulting from any act or transaction of Tenant or of any such <br />other person, Tenant shall save and hold Landlord harmless from <br />any judgment rendered against Landlord or the premises or any <br />part thereof, and all costs and expeses, including reasonable <br />attorney's fee, incurred by Landlord in connection with such <br />litigation. <br />16.6 Time, Joint and Several 'Liability <br />Time is of the essence of this lease and each and every <br />I rovision hereof, except as to the conditions relating to the <br />delivery of possession of the premises to Tenant. All the terms, <br />covenants and conditions contained in this lease to be preformed <br />by either party if such party shall consist of more than one <br />person or organization, shall be deemed to be joint and several, <br />and all rights and remedies of the parties shall be cumulative <br />and non— exclusive of any other remedy at law or in equity. <br />16.7 Binding-Effect; Choice of Law <br />The parties hereto agree that all the provisions hereof <br />are to be constructed as both covenants and conditions as through <br />the words importing such covenants and conditions were used in <br />each separate paragraph hereof; subject to any provisions hereof <br />restricting assignment or subletting by Tenant, all of the <br />provisions hereof shall bind and inure to the benefit of the <br />..parties hereto and their respective heirs, legal representative, <br />successors and assigns. This lease shall be governed by the law <br />of the State of California. <br />16.8 Waiver <br />-27- <br />
