Grantor owns that certain real property situated in the City of San Leandro, <br />California, as more particularly described in Exhibit A attached hereto and incorporated herein <br />(the "Property "). <br />B. Grantee desires to obtain a non - exclusive easement for the installation, maintenance, <br />and use of creels monitoring equipment over a portion of the Property. <br />NOW, THEREFORE, the parties agree as follows: <br />1. Grant of Easement Subject to the terms and conditions hereinafter set forth, Grantor <br />hereby grants to Grantee a non - exclusive Easement over the western four hundred (400) feet of <br />the Property as described in Exhibit B. In consideration for such a grant of Easement, Grantee <br />agrees to comply with all of the terms and conditions set forth herein. <br />The use of the Easement granted herein shall be limited to the installation, maintenance, and use <br />of creek monitoring equipment as more particularly described as follows: <br />a. Grantee may install four (4) metal boxes each approximately four (4) feet wide by four <br />(4) feet long by five (5) feet high and one (1) metal box approximately two (2) feet wide <br />by two and a half (2.5) feet long by one (1) foot high by on concrete foundations. <br />b. Grantee may install equipment within the boxes. <br />c. Grantee may install a solar panel with maximum dimensions of two (2) feet long by two <br />(2) feet wide by three (3) inches thick on a pole of maximum height ten (10) feet with a <br />concrete foundation and underground conduit/conductors from the pole to the metal <br />boxes. <br />
