CONDITIONS OF APPROVAL <br /> PLN201 1 -00018 — 1285 Hays Street <br /> Destined 2 Dance (Applicant) and Rodney M. Simas (Property Owner) <br /> COMPLIANCE WITH APPROVED PLANS <br /> • <br /> A. The property owner and/or applicant shall comply with Exhibit A, dated June 15, 2011 except <br /> as hereinafter modified. (Exhibits are on file at the City of San Leandro Development <br /> Services Department, 835 East 14th Street, San Leandro, California). <br /> Exhibit A — Site Plan & Floor Plan <br /> B. The property owner and/or applicant shall be responsible for assuring that any successor in <br /> interest who assumes responsibility for the zoning approval is informed of its terms and <br /> conditions. <br /> C. Construction of tenant improvements shall commence within one (1) year following <br /> Zoning Enforcement Official's approval of the Administrative Review and shall be <br /> substantially completed one year after commencement of construction. For the purpose of <br /> compliance with this condition, commencement of construction shall be defined as the <br /> construction of a substantial portion of the tenant improvements <br /> I1. PERMITTED USES <br /> A. This is an Administrative Review approval that allows dance instruction to recorded music at <br /> 1285 Hays Street; Assessor's Parcel Number 75- 16 -13. <br /> B. The days and hours of operation will be seven days per week, between the hours of 9 a.m. to <br /> 10:00 p.m. <br /> C. Any modification to the hours or days of operation, or relocation of the business on the <br /> property or the expansion of the business shall be requested in writing to the Zoning <br /> Enforcement Official. <br /> D. This approval is for dance instruction only and the space is not to be used by the applicant <br /> or rented out for any other dancing or performance activities or functions. <br /> E. There shall be no sale or consumption of alcoholic beverages or food. <br /> F. All doors shall be kept closed when music is being played, and signs shall be posted on the <br /> doors to that effect. <br /> G. The volume of the music shall not be detectable beyond the exterior boundary of the <br /> property. Any complaints received by the City regarding noise from this use shall be re- <br /> reviewed by the Community Development Director to provide directive for the property <br /> owner or applicant to implement noise controls or direct the matter to the Board of Zoning <br /> Adjustments for its consideration. <br /> H.
