IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011 -202 <br /> RESOLUTION TO RESCIND RESOLUTION NO. 2011 -154, AWARD OF CONSTRUCTION <br /> CONTRACT TO MUSCO EXCAVATION, INC. FOR THE 14901 EAST 14 STREET <br /> DEMOLITION PROJECT, PROJECT NO. 11- 962 -39 -001 <br /> WHEREAS, the City Council on September 6, 2011, by Resolution No. 2011 -154 <br /> awarded a construction contract to Musco Excavation, Inc. for the 14901 East 14 Street <br /> Demolition project, Project No. 11- 962 -39 -001; and <br /> WHEREAS, after the award, Musco Excavation, Inc. notified the City Engineer that it <br /> was unable to execute the contract, to which the City took action to advance upon Musco <br /> Excavation, Inc.'s bid security to recover the difference between its bid and the next lowest <br /> responsible bidder's bid, and to notify the next lowest responsible bidder, VEM General <br /> Engineering, that it would be awarded the contract for the Project <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That the City Council hereby rescinds City Council Resolution No. 2011 -154, which <br /> awarded the construction contract for 19401 East 14 Street Demolition Project, Project No. 11- <br /> 962 -39 -001 to Musco Excavation, Inc. <br /> Introduced by Councilmember Reed and passed and adopted this 5th day of December, <br /> 2011, by the following vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Gregory, Prola, Reed, Souza, Starosciak; <br /> Mayor Cassidy (7) <br /> NOES: None (0) <br /> ABSENT: None (0) <br /> ATTEST: 14v l tut u2 01/14_01s(_. <br /> Marian Handa, City Clerk <br /> • <br />
