IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011-198 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO SERVICE <br /> CONTRACT NO. 75LX204 WITH THE STATE OF CALIFORNIA, DEPARTMENT OF <br /> TRANSPORTATION, FOR FUNDS FROM THE AT -GRADE HIGHWAY RAIL CROSSING <br /> PROGRAM FOR THE HESPERIAN BOULEVARD AT SPRINGLAKE DRIVE RAILROAD <br /> CROSSING <br /> WHEREAS, this Service Contract is for the elimination of hazards at Railroad - Highway <br /> intersections (crossings); and <br /> WHEREAS, the project is located in the City of San Leandro (City), at the grade crossing <br /> located at the intersection of Hesperian Boulevard and the Union Pacific Railroad tracks, CPUC <br /> No. 001D17.50, Federal DOT No. 749745L; and <br /> WHEREAS, funding for this Service Contract is provided to the State of California, <br /> Department of Transportation (Department) under Section 130, Title 23 USC; and <br /> WHEREAS, said elimination of hazards is a cooperative effort between the Department, <br /> the City, the Califomia Public Utilities Commission (CPUC) and Union Pacific Railroad <br /> (Railroad); and <br /> WHEREAS, the CPUC has evaluated the crossing and determined what improvements <br /> are necessary; the Department acts as a conduit for the federal funds to the City and Railroad and <br /> the City are responsible for building and maintaining the improvements mandated by the CPUC; <br /> and <br /> WHEREAS, that an agreement between the City and Department, a copy of which is <br /> attached, has been presented to this Council; and <br /> WHEREAS, the Council is familiar with the contents of the Service Contract; and <br /> WHEREAS, the City Manager has recommended approval of said Service Contract. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That the City hereby agrees to do the work as described in the Service Contract for the <br /> Department in accordance with all applicable laws including but not limited to, California Streets <br /> and Highway Code section 114(b) and California Government Code 14038 and regulations and <br /> the provision of the Service Contract and attached exhibits; and <br />
