Legal Counsel has advised that it would be <br />good practice to provide an information item to the Council. <br />How frequently will the Oversight Board meet? <br />The law does not provide any requirements; however, the Oversight Board will need to meet <br />twice annually, to approve the ROPS and administrative budgets. It is anticipated that the <br />Board will initially need to meet frequently. <br />How soon can the Oversight Board begin work? <br />This is not specified in the law, however, once four appointees have been named, the Board <br />will have a quorum and be able to conduct business. <br />What are the Board's responsibilities for noticing and public meetings? <br />The Oversight Board is deemed a local agency for purposes of the Brown Act, the California <br />Public Records Act, and the Political Reform Act of 1974. All notice required by law for <br />proposed Oversight Board actions shall also be posted on the Successor Agency's web site or <br />the Oversight Board's internet web site. <br />How long is the term for a member of the Oversight Board? <br />The law does not prescribe a fixed term for appointees, however, Commencing July 1, 2016, <br />in each county where there is more than one Oversight Board, all Boards in the County will be <br />replaced by a single Oversight Board. This new Board will be comprised of new appointees. <br />Can elected officials, including City Councilmembers, serve on an Oversight Board? <br />Yes. A member of an Oversight Board may hold an office in a city, county, special district, <br />school district or community college district. Similar to the Mayor's appointments, the County <br />Board of Supervisors can appoint two people, one of whom can be anyone, including a City <br />Council member. <br />Can appointees serve on multiple Oversight Boards? <br />Yes. An appointee may simultaneously be appointed to up to five oversight boards. <br />Who has the power to override actions of the Oversight Board? <br />Oversight Board actions are subject to review by the Department of Finance. As such, all <br />Oversight Board actions are not effective for three days pending a request for review by the <br />Department. Board actions become effective if no request is received from the Department <br />within those three days. If the Department of Finance does elect to review a decision of the <br />Oversight Board, it has 10 days from the date of its request to approve the action or return it <br />for reconsideration. <br />Can members be removed from the Oversight Board? <br />Each member of an Oversight Board will serve at the pleasure of the entity that appointed the <br />member, and can presumably be removed at any time. <br />Who is responsible for legal and administrative support to the Oversight Board? <br />The law provides that the Oversight Board may direct staff of the Successor Agency to <br />perform work in furtherance of the Oversight Board's responsibilities.
