Implementation of this sales tax is authorized under <br />the Local Transportation Authority and Improvement <br />Act, California Public Utilities Code Section 180000 et <br />seq. In enacting this ordinance, voters will authorize <br />the Alameda County Transportation Commission <br />(referred to herein as the Alameda CTC) to have the <br />responsibility to administer the tax proceeds in <br />accordance with all applicable laws and with the <br />Transportation Expenditure Plan (TEP). Funds <br />collected for this tax may be spent only for the <br />purposes identified in the TEP, as it may be amended <br />as described in the implementation guidelines. Under <br />no circumstances may the proceeds of this <br />transportation sales tax be applied to any purpose <br />other than for transportation improvements <br />benefitting Alameda County. Under no circumstances <br />may these funds be appropriated by the State of <br />California or any other governmental agency. <br />The Alameda County Transportation Commission <br />was created in July 2010 through a merger of two <br />existing agencies: the Alameda County <br />Transportation Improvement Authority, which <br />administered the existing Measure B half -cent <br />transportation sales tax, and the Alameda County <br />Congestion Management Agency, which was <br />responsible for long-range planning and <br />programming of transportation funds. The merger <br />was designed to save taxpayer money by developing <br />a single, streamlined organization focused on <br />planning, funding and delivering countywide <br />projects and programs with local, regional, state and <br />federal funds in the most efficient and effective <br />manner to serve the county's transportation needs. <br />The merger has resulted in millions of dollars of <br />savings to taxpayer's on an annual basis. <br />VERNING BODY AND <br />ORGANIZATIONAL <br />STRUCTURE <br />GOVERNING BODY AND <br />ADMINISTRATION <br />The Alameda CTC is governed by a Commission <br />comprised of 22 members, with the following <br />representation: <br />• All five Alameda County supervisors <br />• Two Oakland representatives <br />• One representative from each of the other 13 <br />cities <br />• AC Transit <br />• BART <br />The Commission is assisted by staff dedicated to <br />implementation and monitoring of sales tax projects <br />and programs. The total cost assigned for salaries and <br />benefits for administrative employees shall not <br />exceed 1% of the revenues generated by the sales tax. <br />The total cost of administration of this tax, including <br />all rent, supplies, consulting services and other <br />overhead costs will not exceed 4% of the proceeds of <br />the tax. In addition, $XXX has been budgeted to <br />repay a loan from the Alameda CTC for the election <br />costs of the Measure. <br />INDEPENDENT WATCHDOG <br />COMMITTEE <br />The Independent Watchdog Committee will have the <br />responsibility of reviewing and overseeing all <br />expenditures of sales tax funds by the Alameda CTC. <br />The Independent Watchdog Committee (IWC) <br />reports directly to the public. <br />
