ACTIA 2002 -26 <br /> APPENDIX 1) <br /> POLICY REGARDING THE TIDING LIMITATION FOR ENVIRONMENTAL <br /> APPROVAL <br /> INTENT <br /> The ACTIA adopted "Alameda County's 20 -year Transportation Expenditure Plan" (PLAN) <br /> contains provisions for geographic equity. Projects which cannot clear the Environmental <br /> Approval process or cannot do so in a timely manner are subject to deletion under the PLAN by <br /> declaring the unencumbered funds as "unused funds ". Unused funds are returned to the <br /> geographic area thereby maintaining the geographic equity included in the PLAN. <br /> The PLAN establishes a deadline for enviromnental approval for each PROJECT that receives <br /> Measure B funding. Approval is defined as the issuance of a Categorical Exclusion (CE), a <br /> Finding of No Significant impact (FONSI) or the filing of the Record of Decision (ROD) for <br /> NEPA documents and the Notice of Determination (NOD) or Notice of Exemption for CEQA <br /> documents. That deadline is April 1, 2007, however the PLAN includes provisions for one -year <br /> extensions to the deadline, if approved by the ACTIA Board. <br /> The intent is to assure continued "due diligence" by the SPONSOR to secure environmental <br /> clearance. <br /> POLICY <br /> This policy is to clarify the requirements for one -year extensions. <br /> 1. In the event that the Administrative Draft Environmental Document has not been <br /> submitted for public review by April 2007, no time extension will be recommended, <br /> and staff will recommend that the project be deleted from the PLAN. <br /> 2. A time extension of one year may be recommended for projects where the <br /> SPONSOR has started the environmental process, and has worked diligently on <br /> critical items in an ACTIA - approved project schedule showing initial completion <br /> before April 2007. <br /> 3. Projects meeting the criteria of requirement No. 2 needing additional extensions <br /> shall be required to make application to the ACTIA Board to justify any additional <br /> extensions. <br /> 4. Projects with an original ACTIA- approved schedule starting the Environmental <br /> Document prior to April 2003 and showing environmental approval after April 2007 <br /> shall automatically be recommended for extensions to the year of scheduled <br /> approval. ACTIA will not approve any schedule under this condition unless the <br /> environmental document is started prior to April 2003. <br /> Final 5/16/02 Page D -8 <br />
