IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012 -101 <br /> RESOLUTION ACCEPTING THE WORK FOR THE 2009 SANITARY SEWER PIPELINE <br /> REPLACEMENT PROJECT, PROJECT NO. 09- 593 -52 -21 1 <br /> WHEREAS, pursuant to a construction contract between the City of San Leandro and <br /> D'Arcy & Harty Construction, Inc., approved on September 7, 2010, by Resolution No. 2010- <br /> 112, D'Arcy & Harty Construction, Inc. completed the 2009 Sanitary Sewer Pipeline <br /> Replacement Project (Project No. 09- 593 -52 -211); and <br /> WHEREAS, said work was completed in accordance with the plans and specifications <br /> and to the satisfaction of the Engineering and Transportation Director, who therefore <br /> recommends that said work be accepted. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That the work hereinbefore described is hereby accepted; and <br /> 2. That the City Clerk is hereby directed to file a Notice of Completion on said <br /> project; and <br /> 3. That the bonds heretofore given for performance and payment of said conditions <br /> are hereby discharged and exonerated from further liability; and <br /> 4. That upon completion of the one -year maintenance period established pursuant to <br /> said contract, and to the satisfaction of the Engineering and Transportation Director, the City <br /> Manager is hereby authorized to release the bond heretofore given for maintenance of the work <br /> hereinbefore described. <br /> Introduced by Councilmember Prola and passed and adopted this 4th day of September, <br /> 2012, by the following called vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Gregory, Prola, Reed, Souza; Mayor Cassidy (6) <br /> NOES: None (0) <br /> ABSENT: None (0) <br /> ATTEST: L._:IA %AA-. / <br /> Marian Handa, City Clerk <br />
