TO: City Council FROM: Chris Zapata City Manager <br />BY: Uchenna Udemezue Engineering & Transportation Director FINANCE REVIEW: David Baum Finance Director TITLE: Staff Report for a Resolution of Award of Construction Contract to Calstate <br />Construction, Incorporated, for the Marina Group Picnic Areas Project, Project Number 11-150-62-107 SUMMARY AND RECOMMENDATIONS Staff recommends award of contract to the lowest responsible <br />bidder Calstate Construction, Incorporated, in the amount of $719,500 for the subject project BACKGROUND On March 2, 2009, the City received a Project Grant Amount of $3,740,998 from <br />the East Bay Regional Park District (EBRPD) pursuant to the Measure WW Park Bond. The funds are for the acquisition and development of neighborhood, community, regional parks, and recreation <br />lands and facilities. The City staff asked citizens for their input on how they would like the money spent, and then chose to proceed with the top ten projects. The subject project received <br />an allocation of $988,000 to renovate three group picnic areas (the Seagull, Mallard, and Otter areas) at Marina Park. These three picnic areas are over 40 years old, and their original <br />wooden shade structures were removed several years ago due to deterioration. This project will renovate each picnic area with new concrete, wind screens, picnic tables, barbeque pits, <br />serving tables, trash cans, and fabric panels for shade. Construction of this project is scheduled to overlap with another City project to replace the irrigation system at Marina Park <br />(Project No. 11-150-62-111). Portions of Marina Park will be closed for construction for both of these projects starting in late 2012. Analysis The City Council authorized the City Manager <br />to approve the plans and specifications and call City of San Leandro Page 1 Printed on 9/25/2012 <br />File Number: 12-398 for bids on July 16, 2012. Plans were signed by the City Engineer and advertised for bid on August 13, 2012. The bids were opened on Tuesday, September 4, 2012. Five <br />(5) bids were received ranging from $719,500 to $1,090,000. Calstate Construction, Incorporated, is the lowest responsible bidder based on a bid of $719,500. The engineer's estimate <br />for the work is $751,040. Previous Actions · On July 16, 2012, by Resolution No. 2012-085, the City Council authorized the City Manager to approve the plans and specifications and call <br />for bids on the subject project · On February 17, 2009, by Resolution No. 2009-023, the City Council authorized the application for grant funds from East Bay Regional Park District under <br />Measure WW, the Park Bond Extension Committee Review and Actions This project was presented at the May 9, 2012 Facilities and Transportation Committee meeting. Applicable General Plan <br />Policies This project is consistent with General Plan Goal No. 21 -Rehabilitation of existing parks policy. Permits and/or Variances Granted The contractor must obtain a building permit <br />from the City of San Leandro Community Development Department for installation of the shade structures. Environmental Review A CEQA review was completed for the project and it was determined <br />to be Categorically Exempt in accordance with CEQA section 15301, Existing Facilities. A Notice of Exemption for this project was filed with Alameda County on March 26, 2010. Code Compliance <br />Review All improvements shall meet current accessibility requirements. Summary of Public Outreach Efforts · A public meeting was held onsite on August 20, 2011 prior to the start of <br />project design and questionnaires were also sent out by the Recreation and Human Services Department to prior users of the group picnic areas · This project was presented at the May <br />9, 2012 City Council Facilities and Transportation Committee · The conceptual design was posted on the City’s website and presented at the San City of San Leandro Page 2 Printed on 9/25/2012 <br />2012File Number: 12-398 Leandro Farmer’s Market on Wednesday, July 18, 2012 Fiscal Impacts · The total cost of the Marina Group Picnic Area renovations project is $988,000 · Construction <br />cost is estimated to be $920,000; including contingencies. Budget Authority The improvements will be funded using Measure WW grant funds provided by the East Bay Regional Park District, <br />appropriated in CIP Account No. 150-62-107 approved by City Council as part of the 2010-2011 City budget. NOW, THEREFORE, the City Council of the City of San <br />Leandro does RESOLVE as follows: That said City Council hereby rejects all of said proposals or bids except that herein mentioned; hereby waives any irregularities in the proposal or <br />bid of the lowest responsible bidder; and hereby awards the contract for doing said work to the lowest responsible bidder therefore, to wit Calstate Construction, Incorporated, at the <br />prices named in its bid on file in the Office of the City Clerk. BE IT FURTHER RESOLVED: That if the above named contractor is unable to execute the contract, then the City Manager is <br />authorized to award this contract to the next lowest responsible bidder, execute all documents to effect the award, and take all actions necessary to recover any bid security from City <br />of San Leandro Page 1 Printed on 9/25/2012 <br />File Number: 12-397 the low bidder necessary to make the City whole in its acceptance of the lowest bid.
