• <br /> social deficiencies through expanding employment opportunities, creating superior <br /> vehicular circulation, removing obsolete structures, and developing retail uses in the <br /> Project Area in a matter compatible and consistent with the existing Implementation <br /> Plan and Redevelopment Plan; <br /> WHEREAS, the Agency further found and declared that the consideration to <br /> be paid by Batarse for the real property parcels is not less than fair reuse value given <br /> the restrictions, conditions and covenants the property is subject to pursuant to the <br /> Agreement; <br /> WHEREAS, the Agency found and declared that all environmental clearances <br /> for this Agreement are contained in the Mitigated Negative Declaration adopted by <br /> the City Council for the City of San Leandro, by Resolution No. 96- 61 , and the <br /> Agency, by Resolution No. 96 -09 for the Disposition and Development Agreement <br /> between the Batarse Family Trust and the Agency, and the Agency's Resolution of <br /> Intent to Condemn, and the Agency readopted all findings, conclusions and <br /> mitigations contained in the official records of the City Coucil's and Agency's <br /> proceedings relative to the Mitigated Negative Declaration; and <br /> WHEREAS, the prior findings and declarations of the Agency are hereby <br /> reaffirmed as relates to the final Agreement, as the general terms, covenants, and <br /> conditions of the Agreement remain essentially similar. <br /> NOW THEREFORE, the Redevelopment Agency of the City of San Leandro <br /> hereby approves the. final Disposition and Development Agreement and directs the <br /> Interim Executive Director to execute a Disposition and Development Agreement, <br /> and execute any and all other documents necessary to implement the terms and <br /> conditions thereof, including, but not limited to the purchase agreements for the <br /> easements at 1 152 Marina Boulevard at fair, just and equitable compensation, and <br /> the final forms of the exhibits to the Agreement. <br /> • <br /> • <br /> 2 <br />
