• social deficiencies through expanding employment opportunities, creating superior vehicular circulation, removing obsolete structures, and developing retail uses in the Project Area in a matter compatible and consistent with the existing Implementation Plan and Redevelopment Plan; WHEREAS, the Agency further found and declared that the consideration to be paid by Batarse for the real property parcels is not less than fair reuse value given the restrictions, conditions and covenants the property is subject to pursuant to the Agreement; WHEREAS, the Agency found and declared that all environmental clearances for this Agreement are contained in the Mitigated Negative Declaration adopted by the City Council for the City of San Leandro, by Resolution No. 96- 61 , and the Agency, by Resolution No. 96 -09 for the Disposition and Development Agreement between the Batarse Family Trust and the Agency, and the Agency's Resolution of Intent to Condemn, and the Agency readopted all findings, conclusions and mitigations contained in the official records of the City Coucil's and Agency's proceedings relative to the Mitigated Negative Declaration; and WHEREAS, the prior findings and declarations of the Agency are hereby reaffirmed as relates to the final Agreement, as the general terms, covenants, and conditions of the Agreement remain essentially similar. NOW THEREFORE, the Redevelopment Agency of the City of San Leandro hereby approves the. final Disposition and Development Agreement and directs the Interim Executive Director to execute a Disposition and Development Agreement, and execute any and all other documents necessary to implement the terms and conditions thereof, including, but not limited to the purchase agreements for the easements at 1 152 Marina Boulevard at fair, just and equitable compensation, and the final forms of the exhibits to the Agreement. • • 2
