• • <br /> MEMORANDUM OF UNDERSTANDING 1994 -96 <br /> BETWEEN INTERNATIONAL ASSOCIATION OF FIREFIGHTERS LOCAL 1428 <br /> AND ON BEHALF OF THE ALAMEDA COUNTY FIRE DEPARTMENT <br /> • <br /> THIS MEMORANDUM OF UNDERSTANDING is entered into by the Director or Personnel <br /> and Labor Relations of the County of Alameda for the Alameda County Fire Department, a <br /> political subdivision hereinafter named as "Department" and the International Association <br /> of Firefighters Local 1428, hereinafter named as "Union" as a recommendation to the Board <br /> • of Supervisors of the County of Alameda concerning the conditions of employment to be in. <br /> • effect from January 1, 1994 through December 31, 1996, for employees within the Bargaining <br /> Unit R -019. <br /> SECTION 1. RECOGNITION <br /> The County recognizes the Union as the exclusive bargaining representative for all full-time <br /> permanent and probationary Firefighters, Engineers, Captains and Fire Inspectors in the <br /> Alameda County Fire Department. <br /> SECTION 2. NO DISCRIMINATION <br /> A. DISCRIMINATION PROHIBITED. No persons employed by the Alameda County <br /> Fire Department shall be appointed, reduced, or removed or in any way favored or <br /> discriminated against because of political or religious opinions or affiliations, or <br /> because of race or national origin and, to the extent prohibited by law, no person shall <br /> be discriminated against because of age or sex. <br /> B. NO DISCRIMINATION BECAUSE OF UNION ACTIVITY. Neither the <br /> Department nor Union shall interfere with, intimidate, restrain, coerce, or <br /> discriminate against employees because of their exercise of rights to engage or not <br /> engage in Union activity. <br /> • <br /> SECTION 3. UNION SECURITY <br /> A. MODIFIED MAINTENANCE OF MEMBERSHIP. Employees of the Department <br /> referred to in Section 1 hereof who were members of the Union on the date upon <br /> which this Memorandum is executed shall remain members during the period covered <br /> by this Memorandum, except that such employees may withdraw during the month <br /> of June of any year pursuant to paragraph C. of this section. <br /> B. MODIFIED AGENCY SHOP. Each person employed by the Department on or after <br /> the adoption by the Board of Supervisors of this Memorandum of Understanding shall, <br /> at the time of employment and as a condition of employment, execute an authorization <br /> for the payroll deduction of Union dues or of a service fee equivalent to Union dues <br /> and shall continue said authorization in effect during the period of his/her <br /> employment, except that such employee may initiate a request to withdraw said <br /> authorization within the first thirty days of employment and thereafter during the <br /> month of June of any year as hereinafter provided. Each such authorization form <br /> shall include a statement that the Union and the Department have entered into a <br /> Memorandum of Understanding, that the employee is required to authorize payroll <br /> 167 <br /> • <br /> FIRE - 1 <br />
