• • <br /> SECTION 24. ORGANIZED MESS <br /> All employees on each shift at each station shall attend an organized mess at the station for <br /> consumption of meals. Employees shall contribute in equal shares for the cost of such meals. <br /> The Department shall not be responsible in any manner for the cost of such meals, for the <br /> preparation thereof, for the collection of any funds or for any other costs in connection with <br /> this Section. <br /> SECTION 25. LAYOFF • <br /> . • For employees within the bargaining unit, all layoffs and reductions in force in lieu of layoff, <br /> including recall following layoff, shall be made in accordance with the Alameda County Civil <br /> Service Rules. <br /> SECTION 26. PROPOSITION 4 REOPENER <br /> In the event either the Department or the County will exceed its spending limit as <br /> determined by Proposition 4, and the voters fail to approve a measure to allow exceeding the <br /> limit, this MOU shall be reopened at the request of the County/Department for the purpose <br /> of negotiating personnel costs to comply with the Proposition 4 spending limits. <br /> SECTION 27. PHYSICAL FITNESS PROGRAM <br /> The Department shall continue the mandatory- physical fitness program. <br /> SECTION 28. INUUSTRL&L ILLNESS OR INJURY <br /> Employees incapacitated by sickness or injury received in the course of employment shall, in <br /> lieu of the benefits of Section 11. be granted the benefits set forth in Section 4850 et seq of <br /> the Labor Code. <br /> SECTION 29. NO STRIKE - NO LOCKOUT • <br /> There shall be no lockout or strike. slowdown, work stoppage, job action, or willful absence <br /> from assigned work station, during the life of this Memorandum. The Union agrees to assist <br /> the County/Department in enforcing the provision of this Section. <br /> SECTION 30. MANAGEMENT RIGHTS <br /> The County/Department hereby retains and reserves unto itself all powers, rights, authority, <br /> duties and responsibilities conferred upon and vested in it by the laws and the Constitution <br /> of the State of California and by the County Charter, except as specifically limited, abridged <br /> or relinquished by the terms of this memorandum. <br /> • <br /> 192 <br /> FIRE - 26 <br />
