• <br /> amount 01/1 to one and one -half timli the overtime worked <br /> in lieu of pay, up to a maximum of forty -eight (48) hours <br /> of compensatory time off. <br /> At the department's option, the employer will offer pay or <br /> accumulated time for departmental projects. This option <br /> will be presented to bargaining unit members prior to <br /> their engaging in any project. <br /> • Overtime shall not include hours worked as a result of <br /> voluntary trading of shifts. <br /> Overtime shall be paid pursuant to the Fair Labor <br /> Standards Act. Administration of Compensatory Time shall <br /> • be outlined in a departmental-General Oder after <br /> discussion with representatives of the :ire Fighters' <br /> Association. <br /> For purposes of computing Fai :•Labor Standards Act (FLSA) <br /> overtime, employees shall be covered by Fire Chief <br /> Hamilton's memo of December 27, 1974. This memo.provides <br /> for a 7(k) exemption and a 27 -day work period. The <br /> effective date of this memo shall be April 15, 1986. For <br /> the purposes of computing FLSA overtime, the City shall • <br /> consider three (3) or more consecutive shifts of vacation <br /> taken by an employee as time worked. Holidays scheduled <br /> and taken at the same time as vacation is scheduled and <br /> taken shall be considered for the purposes of this section <br /> as vacation. Accumulated time taken shall not affect FLSA <br /> overtime. The Association, for itself and in its. <br /> representative capacity, waives any claim to overtime <br /> compensation under the FLSA, as amended, prior to April <br /> 15, 1936, and agrees and covenants that any claims to <br /> overtime compensation from April 15, 1986, to the present <br /> shall be .based cn a "work period" of 27 days. <br /> In the event the Atlanta Appellate Court decision <br /> regarding Captains' coverage under FLSA is found to be <br /> applicable to California, the employer will implement that . <br /> interpretation of FLSA in regard to this bargaining unit. <br /> Section 8. Application of Pay Rates <br /> • <br /> Employees may be assigned to perform the duties of a <br /> permanent position in a higher classification a <br /> temporary basis. Such assignments shall be termed "acting <br /> • assignments" and shall be made subject to the following <br /> conditions: <br /> (1) Acting assignments shall be made by the Fire Chief or <br /> designated representative only, with City Manager <br /> approval, and shall be made prior to the beginning of <br /> the shift. <br /> • <br /> -7- <br /> 231 <br />
