• <br /> who has been approved to receive a jo - connected <br /> disability retirement shall, upon request by the affected <br /> employee, be granted by the City a retirement allowance <br /> advance of forty percent (40 %) of final compensation. <br /> Section 28. Modified Duty <br /> • <br /> When an employee cannot perform the full range of duties <br /> of the classification as a result of an illness or injury, <br /> such employee may be assigned modified duty if reasonable <br /> accommodation can be made. Modified duty may be assigned <br /> after medical release by a City - designated physician, <br /> which indicates the employee's work restriction. <br /> • <br /> Section 29. Off -Duty Employment • <br /> When permission for off -duty employment is being <br /> requested, the appropriate Fire Department fora shall be <br /> • completed and sent through channels to the Fire Chief. • <br /> The policy regarding off -duty employment by members of the <br /> San Leandro Fire Department is as follows: <br /> The second occupation cannot be of a nature that it <br /> would tend to be incompatible, embarrass, be a <br /> conflict of interest, or discredit the department or <br /> our City government generally. <br /> The nature of the occupation, or amount of time that <br /> an employee can spend on the same cannot be such that <br /> it will hinder or prevent an employee from effectively <br /> performing his duties for the City. <br /> Any work shall be confined from 0800 to 2400 hours, <br /> and in no event shall work be performed between the <br /> hours cf 0001 and 0700 on the morning of the day . <br /> scheduled for returning to Fire Department duty. <br /> The second occupation shall net result in unfair <br /> competition wit.`. regular employees of any company or <br /> • employer for which part -time employment is undertaken . <br /> (i.e., members of the department shall not work for a <br /> lesser equivalent wage rate than that paid regular <br /> employees). <br /> The City of San Leandro will not be subject to claim, <br /> or be held liable for any damages or injuries incurred <br /> through outside employment. <br /> Upon termination of the second occupation, Fire <br /> Department Form A -10a shall be completed and sent <br /> through channels to the Fire Chief. <br /> Sick leave shall not be granted to an employee who is <br /> absent from duty due to illness or injury incurred •, <br /> 250 -26- • <br /> • <br /> • <br />
