• <br /> optional pr payment to be used t..711 Ed an individual <br /> medical supplement conversion plan, under which retirees <br /> may be offered the option of taking a reduced premium <br /> contribution by the City prior to reaching age sixty -five <br /> • (65). The availability of such coverage, the cost <br /> thereof, and other =elated matters is unknown to the <br /> parties at this time. However, the parties agree to meet <br /> during the term of this agreement to explore such options • <br /> and alter natives. In no case, shall the City's obligation <br /> to pay premiums exceed the sums and /or costs described in <br /> Section 24.2. <br /> Section. 25. Retirement Plan <br /> • <br /> • The City shall'continue to contract with the Public' <br /> Employees' Retirement System to provide retirement benefit <br /> during the term of this Memorandum of Understanding for <br /> current employees under the 2% at age 50 retirement <br /> • formula. Such plan shall contain an after re- marriage <br /> post - retirement survivor allowance continuance. <br /> • Section 26. Safety and Health <br /> The City shall conform with applicable safety regulations <br /> provided by State law to ensure the employees' reasonable <br /> safe working conditions. The employees agree to conduct • <br /> themselves and the Association agrees to encourage its <br /> members to conduct themselves and use their equipment and <br /> to abide by the guidelines of the applicable City of San <br /> Leandro General Safety Rules and applicable departmental <br /> rules. In the event an employee leaves the Fire <br /> Department, the employee shall return all City provided • <br /> safety equipment to the Department. <br /> The City is effectuating the safety items pursuant to <br /> • N.F.P.A. 1500 in an orderly and timely fashion in <br /> conjunction with available economic resources. <br /> Section 27. Injury on Duty - • <br /> When an employee is incapable of performing work or duties" <br /> as a result of injuries received or illness arising in the <br /> course of employment by the City, and receives benefits <br /> pursuant to the Workers' Compensation laws of the State of <br /> California, upon the sole discretion of the City Manager, <br /> the employee may be granted a leave with compensation <br /> benefits determined and paid in accordance with the <br /> Workers' Compensation laws of the State of California. <br /> Leave granted an employee under the above provisions shall <br /> not be considered sick leave or deducted from accumulated <br /> sick leave. <br /> An employee represented by the Fire Fighters' Association, <br /> -25- - - 249 <br />
