i . <br /> existing provision of this Memorandum of <br /> Understanding, the City's Personnel Ru' -es, and <br /> Department rules which involve matters which fall <br /> within the scone of representation. Excluded are all <br /> other ordinances, resolutions, rules and regulations. <br /> Such excluded ordinances, resolutions, rules and <br /> regulations shall not be subject to the Grievance <br /> Procedure. Also specifically excluded from the <br /> Grievance Procedure are verbal reprimands and letters <br /> of warning. . <br /> (2) Grievances as defined in (1) above shall be processed . <br /> only in the following manners . <br /> For the purpose of this subsection (a) as well as <br /> subsections (b) and (c) below, the term "days" shall <br /> • be defined as an eight (8) hour working day which <br /> • corresponds to a regularly scheduled forty (40) hour <br /> (AM Monday - PM Friday) work week. time frames for <br /> processing grievances which occur after the regular <br /> work day defined above shall begin on the next <br /> regularly scheduled work day. <br /> (a) An employee, in the presence of Association <br /> representative if the employee desires, who wishes <br /> to file a grievance shall discuss the issues with <br /> a management official in the department designated <br /> by the Fire Chief. This recuest for this initial <br /> discussion must occur within ten (10) days of the <br /> • occurrence giving rise to the grievance. In the <br /> event the employee is not satisfied, or has not <br /> received a response within five (5) days of the <br /> . initial discussion, the grievance may be referred <br /> • to the Association who may seek a resolution with <br /> . the management of the department or invoke the .. <br /> procedures hereinafter specified. <br /> (b) No later than thirty (30) days after the <br /> occurrence giving rise to the grievance, the <br /> Association may notify the Personnel Director or • <br /> designated representative in writing that a , <br /> grievance exists, and in such notification state . <br /> • the particulars of the grievance and, if possible, <br /> the nature of the determination which is desired. <br /> All grievances involving or concerning the payment <br /> of compensation shall be initially filed in <br /> writing with the Personnel Director. The • <br /> ' - Personnel Director or designated representative <br /> shall thereupon investigate the issues involved, . <br /> meet with the grievant and attempt to reach a <br /> satisfactory resolution of the problem. No <br /> grievance may be processed under paragraphs (c) <br /> and (d) below which has not first been filed and <br /> investigated in pursuance of this paragraph (b). . <br /> -29- • - -- - 253 <br /> • <br />
