�Qosals to add to or chan,his Memorandum of <br /> • understanding - or written agreements or addenda <br /> supplementary hereto shall not be arb'- trable and <br /> no proposal to modify, amend or terminate this <br /> Memorandum of Understanding, nor any matte= or <br /> subject arising out of or in connection with such <br /> proposal, may be referred for arbitration under <br /> this section; and nor shall any Arbitrator have <br /> the power to amend or modify this Memorandum of <br /> Understanding or written agreements or addenda <br /> supplementary hereto or to establish any new terms . <br /> or conditions of employment. <br /> • <br /> (3) No changes in the Memorandum of Understanding or <br /> interpretations thereof (except int_erpret . <br /> resulting from arbitration proceedings he=eunder)' . <br /> be recognized unless agreed to by the City Manager and <br /> the Association. <br /> (4) Failure on the part of the employee or Association to <br /> meet a timeline in this procedure constitutes an <br /> abandonment of the grievance. Failure on the part of <br /> the City to meet a timeline in this procedure shall <br /> result in the grievance being advanced to the next <br /> level. <br /> (5)' The Association, its members and representatives agree <br /> that it and they will not engage in, authorize, <br /> sanction, or support any strike, slowdow-, stoppage of <br /> wcrk, curtailment of production, concerted refusal of <br /> overtime work, refusal to operate designated equipment <br /> or to perform customary duties; and neither the <br /> Association nor any representatives thereof shall <br /> engage in job action for the purpose cf effecting <br /> changes in the directives or decisions of management <br /> of the City, nor to effect a change of personnel or <br /> operations of management or of employees not covered <br /> by this Memorandum of Understanding. <br /> Section 33.
