SECTIONS. LEAVES OF ABSENCE (Cont. DRAFT <br /> 1. Paid military leave which may be granted during a fiscal year is limited to an <br /> aggregate of 30 calendar days during ordered military leave, including weekend <br /> days and travel time. <br /> 2. During the period specified in 8.A.1. above, the employee shall be entitled to receive <br /> pay only for those shifts or fractions of shifts which the employee would have been <br /> scheduled to work and would have worked but for the military leave. <br /> 3. The rate of pay and accrual of benefits shall be the same rate the employee would <br /> have received for shifts/work days he/she would have been . scheduled to work or <br /> scheduled for paid holiday leave, had he/she not been on military leave. . - . <br /> 4. In no event shall an employee be paid for time he/she would not have been <br /> scheduled to work during said military leave. <br /> Time spent on military leave shall be included in determining eligibility to occupy a <br /> classification based upon length of service. <br /> B. BEREAVEMENT LEAVE. Leave of absence with pay because of death in the immediate <br /> family of a person in the Department service may be granted by the Chief for a period not <br /> to exceed three consecutive scheduled shifts or equivalent days. Entitlement to leave of <br /> absence under this section shall be in addition to any other entitlement for sick leave, <br /> emergency leave, or any other leave. For purposes of this section, "immediate family" <br /> • <br /> means mother, stepmother, father, stepfather, husband, wife, son, stepson, daughter, <br /> stepdaughter, brother, sister, foster parent, foster child, or any other person sharing the <br /> relationship of in loco parentis and also includes a brother -in -law, sister -in -law, mother -in- <br /> law, father -in -law, grandparents and grandparents -in -law. <br /> C. LEAVE FOR JURY DUTY. Leave of absence with pay shall be granted to an employee <br /> while serving on jury duty and while going to and from jury duty, provided that the jury <br /> duty takes place during a shift when that employee is normally scheduled to work. Any <br /> jury fee awarded to such employee for jury duty served during such leave shall be <br /> deposited with the Department. The employee shall complete the scheduled shift at the <br /> conclusion of the day's jury duty, except that if the employee must report for jury duty the <br /> next day, he/she shall not be required to complete the shift. <br /> D. MATERNITY LEAVE. Pregnant employees shall furnish the Department Head, no later <br /> than the fourth month of pregnancy, a statement of the attending physician which <br /> indicates the estimated date of delivery. A pregnant employee is entitled to a maternity <br /> leave of up to four months, the dates of which are to be mutually agreed by the employee <br /> and Department Head, provided that the employee is required to take maternity leave two <br /> weeks prior to the estimated date of delivery, unless the employee's physician submits <br /> written approval, satisfactory to the Department Head, for the employee to work during <br /> such period. Such an employee may elect to take accrued vacation or compensating time <br /> off or sick leave during the period of maternity leave, except that in the case of an <br /> employee who is regularly scheduled to work less than the normal full -time work week for <br /> the classification, paid leave shall be granted only for <br /> IAFF Local 1428- Management Unit R-34 <br /> January 1, 1994- December 31, 1995 <br /> 4 <br /> 2 1428- M/Dft.2 <br /> RU:Im- W16/86 <br />
