SECTION 18. EIEVANCE PROCEDURE �:% 1 F J • <br /> Saturdays, Sundays, and holidays, after the date of such informal discussion. <br /> Within seven calendar days, Saturdays, Sundays, and holidays excluded, after <br /> receipt of any written grievance, the immediate supervisor shall reply to the <br /> grievance in writing. If the grievance is not resolved at this level, the employee <br /> shall have seven calendar days, excluding Saturdays, Sundays, and holidays, from <br /> receipt of the answer within which to file an appeal with the next highest level of <br /> supervision. <br /> 3. Step Three: The supervisor at the next highest level of supervision shall have <br /> seven calendar days, from receipt of the appeal, excluding Saturdays, Sundays and <br /> holidays, in which to review and answer the grievance in writing. If the grievance <br /> is not resolved at this level, the employee shall have seven calendar days, <br /> • excluding Saturdays, Sundays, and holidays, from receipt of the answer within <br /> which to file and appeal with the next highest level of supervision as determined' <br /> under subsection M. of this section. <br /> 4. Step Four: If the administrator at the next highest level of supervision is not the <br /> department head, that administrator shall have seven calendar days, excluding <br /> Saturdays, Sundays, and holidays, from receipt of the appeal, in which to review <br /> and answer the grievance in writing. Although no hearing is required at this step, <br /> the employee and his/her representative may be present at, and participate in, any <br /> such hearing as the administrator may conduct. If the grievance is not resolved <br /> at this level, the employee shall have seven calendar days, excluding Saturdays, <br /> Sundays, and holidays, from receipt of the answer within which to file an appeal <br /> with the department head. <br /> 5. Step Five: The Fire Chief shall have seven working days from receipt of the <br /> appeal in which to review, hold hearings, and answer the grievance in writing. <br /> Unless waived by the mutual agreement of the employee or his/her representative <br /> and the department head, a hearing is required at this step and the employee, and <br /> his/her representative shall have the right to be present at, and participate in, <br /> such hearing. The time limit at this step may be extended by mutual agreement <br /> between the department head and the employee or his/her representative. <br /> Union may in its own name file a grievance alleging that the Department has <br /> failed to provide it some organizational right which is established by written <br /> Department rules or by this Memorandum of Understanding provided that such <br /> right is not made subject to the discretion provided that such right is not m <br /> subject to the discretion of the Chief or Department. Such Union grievances shall <br /> be filed with the department head on the form designated by the County and <br /> heard and determined pursuant to the provisions of the fifth step of the grievance <br /> procedure. <br /> E. WAIVER OF APPEAL STEPS.
