SECTION 17. CL•BING ALLOWANCE • DRAFT <br /> The Department shall pay annually a clothing allowance to purchase uniforms as required by the <br /> Department as follows: <br /> July 1, 1994 - $450 <br /> July 1, 1995 - $475 <br /> No proof of purchase is required. Should any uniform be damaged in the performance of duty, <br /> it will be replaced or repaired by the Department. <br /> SECTION 18. GRIEVANCE PROCEDURE <br /> • <br /> A. DEFINITION. A grievance is defined as an allegation by an employee or group of employees <br /> that the Department has failed to provide a condition of employment which'is established by <br /> written Department rules or by this Memorandum of Understanding, provided that the <br /> enjoyment of such right is not made subject to the discretion of the Department, and, <br /> provided, further, that the condition of employment which is the subject matter of the <br /> grievance is a matter within the scope of representation as defined in California Government <br /> Code Section 3504. <br /> B. EXAMINATION AND CLASSIFICATION MATTERS. Examination and classification <br /> matters are • exempt from this grievance procedure and such matters shall be heard by the <br /> Alameda County Civil Service Commission and shall be governed by the provisions of County <br /> Civil Service Rules 1200 - 1260, 1300 - 1354, 1400 - 1456, 1464 -1480 (first paragraph only), <br /> 1484 - 1492, and the procedures and guidelines contained in the Alameda County Personnel <br /> Manual pertaining to examination and classification set forth in Appendix C, as amended <br /> from time to time. In applying the foregoing rules, procedures, and guidelines, the word <br /> • "county" or "department" shall mean the "Fire Department. <br /> C. DISCIPLINE. Discipline and discharge matters are subject to this grievance procedure and <br /> are subject to binding arbitration, except that a probationary employee who is discharged has <br /> no right to appeal unless he/she alleges that his/her dismissal was due to race, religion, <br /> national origin, sex, political, or Union affiliation. The probationary period lasts for 24 <br /> months, from date of employment. <br /> D. DEPARTMENTAL REVIEW AND ADJUSTMENT OF GRIEVANCES. The following is <br /> the procedure to be followed in the resolution of grievances: <br /> 1. Step One: An employee having a grievance shall first discuss it with his/her <br /> immediate supervisor and endeavor to work out a satisfactory solution in an <br /> informal manner with such supervisor. <br /> • <br /> 2. Step Two: If a satisfactory solution is not accomplished by informal discussion, <br /> the employee shall have the right to consult with and be assisted by a <br /> • representative of his/her own choice in this and all succeeding steps of this <br /> subsection D. and may thereafter file a grievance on the form designated by the <br /> Department with the immediate supervisor within seven calendar days, excluding <br /> IAFF Local 1428-Management Unit R-34 <br /> January 1, 1994 - December 31, 1995 <br /> 17 <br /> Local 1428-M/Dft.2 285 <br /> RU:Im•6118i138 <br />
