SECTION 18. S I:VANCE PROCEDURE (Cont'cl) D A <br /> N. EXCLUSION OF NON - RECOGNIZED ORGANIZATIONS. For the purposes of this <br /> section, the provisions of Section 1 of the Memorandum shall be construed to limit the <br /> employee's right of selection of a representative to the extent that agents of any other <br /> employee organization which is not a party to this Memorandum, are specifically excluded <br /> from so acting. The Union shall be notified of all grievances filed pursuant to Section 18.D.2. <br /> In those cases in which an employee elects to represent himself or arranges for independent <br /> representation, the County shall make no settlement or award which shall be inconsistent <br /> with the terms and conditions of this Memorandum. In the event the Union shall determine <br /> that such inconsistent award has been made, the Union, on its own behalf, may file a <br /> grievance pursuant to subsection D.S. of this section for the purpose of amending such award. <br /> In the event any unrepresented, or independently represented employee shall elect to go to <br /> arbitration under paragraph F. hereof, the Union may elect to be a full and equal party to <br /> such proceeding for the purpose of protecting the interests of its members in negotiated <br /> conditions of employment. <br /> • <br /> SECTION 19. LAYOFF <br /> For employees within the bargaining units, all layoffs and reductions in force in lieu of layoff, <br /> including recall following layoff, shall be made in accordance with the Alameda County Civil <br /> Service Rules. <br /> SECTION 20. RETIREMENT <br /> Employees of the Alameda County Fire Department are members of the Public Employees' <br /> Retirement System. The PERS benefit formula is "2% at age 50 ". Members are entitled to the <br /> 1957 Survivors Benefits and the 1959 Survivors Benefits. The final compensation average is one <br /> year. <br /> SECTION 21. PHYSICAL FITNESS PROGRAM <br /> The Department shall continue a physical fitness program. Department equipment is available <br /> to be used as can be scheduled. <br /> SECTION 22. INDUSTRIAL ILLNESS OR INJURY <br /> Employees incapacitated by sickness or injury received in the course of employment shall, in lieu <br /> of the benefits of Section 11. of this Memorandum of Understanding, be granted the benefits ser <br /> forth in Section 4850 et seq. of the State Labor Code. <br /> IAFF Local 1428 - Management Unit R-34 <br /> January 1, 1994 - December 31, 1995 <br /> 20 <br /> - 2 8 8 Local 1428-M/D(t2 <br /> RU 1m -& 5I 5 <br />
