The names of laid off probationary employees shall be placed on a County -wide re- <br /> employment list if they were laid off from the probationary class. <br /> Certification and appointment from the County -wide re- employment list shall be made in <br /> accordance with the provisions of these rules governing certification and appointment.. <br /> Acceptance of an appointment.from a County -wide re- employment list shall not affect the right <br /> of any tenured employee to re- employment in the class and department from which the employee <br /> was laid off or from which the employee accepted demotion, but will result in the employee's <br /> name being removed from all other County -wide or departmental preferred lists for positions of <br /> equal or lower level salary. If the accepted position was for a lesser. number of hours than <br /> previously worked by the employee, acceptance will not result in the removal of the employee's <br /> name from any full-time lists. When more than one County -wide re- employment list exists due <br /> to multiple lay -offs or reclassification action(s) and lay -off, the lists shall be combined for each <br /> class with persons on the list being ranked in order of Total County Service or in inverse order <br /> of lay -off for Sheriffs Department sworn classes based on total paid service for the class as set <br /> forth in Rule 2014. Total County Service shall be determined as of the effective date of the lay -off <br /> or classification action. <br /> 2024 Right to Compete for Promotion <br /> An employee who has re- employment rights as provided in Rule 2016, shall have the same right <br /> to compete for promotion that he/she would have had if he/she had not been laid off or had not <br /> accepted demotion in lieu of lay -off. Such employee shall be admitted to a promotional <br /> examination and shall be given preferential promotion credits in an open examination as provided <br /> in Rule 1484. <br /> 2028 Re- Employment Following Disability Retirement <br /> Any employee who has been retired because of disability before reaching the ordinary minimum <br /> retirement Age, and who under the provisions of the retirement act has been medically re- <br /> examined and has been found to be able to engage in gainful employment shall be eligible for re- <br /> employment, either in the position he/she occupied or in another position for which he/she may <br /> be found to be qualified. When such position is in a department other than the one from which <br /> the employee retired, the consent of the head of the department is required before such re- <br /> employment shall become effective. <br /> 2032 Re- Appointment to Temporary Position <br /> Any person from among the eligibles with the five (5) highest scores willing to accept temporary <br /> appointment, who is appointed to a temporary position of an as needed nature, may be re- <br /> appointed to such position on the request of the department head without having to be certified <br /> again from the list, notwithstanding the fact that at the time of such re- appointment that person <br /> may not be within the five (5) highest scores of those eligibles willing to accept temporary work. <br /> IAFF Local 1428- Management Unit R-34 <br /> January 1, 1994- December 31, 1995 <br /> 38 <br /> 3 }� <br /> 0 6 Local 1428-M/DfL2 <br /> HU:Im.&18195 <br />
