provisions of Section 1.02 of this Agreement for the entire Term of the Loan, the <br /> City shall forgive the loan at the end of the Term. If Recipients sells the Property, <br /> the Loan shall become due and payable upon sale, except that Recipient may transfer <br /> the Agreement to another safe house use upon the written approval of the <br /> Development Services Director and after providing City with a security interest to <br /> secure Recipient's obligations pursuant to this Agreement. <br /> Exhibit A Work Program <br /> Exhibit B Conditions of Payment <br /> Exhibit C Certificate of Insurance <br /> Exhibit D Property Management Standards <br /> Exhibit E General Federal/State Conditions <br /> Exhibit F Regulatory Agreement <br /> SECTION 1.02 USE OF FUNDS <br /> The Loan shall be used solely for the acquisition of a safe house pursuant to <br /> the Work Program set forth in Exhibit A. The Loan funds shall be disbursed <br /> pursuant to the Conditions of Payment set forth in Exhibit B, attached hereto and <br /> incorporated herein. Recipient shall execute the Certificate of Insurance in the form <br /> set forth in Exhibit C, attached hereto and incorporated herein. Recipient shall <br /> comply with the Property Management Standards set forth in Exhibit D, attached <br /> hereto and incorporated herein and the General Federal/State Conditions set forth in <br /> Exhibit E, attached hereto and incorporated herein. <br /> SECTION 1.03 USE OF CDBG FUNDS <br /> Recipient agrees to execute a regulatory agreement in substantially the same <br /> form as Exhibit F, attached hereto and incorporated herein, that will be recorded as a <br /> deed restriction and will specify the use of the property as a safe house for a period <br /> that will last at least thirty (30) years from the date of execution. <br /> SECTION 1.04 DISBURSEMENT OF FUNDS <br /> No funds shall be disbursed until Recipient executes a Promissory Note and <br /> Deed of Trust providing City with a security interest in the Property. The <br /> Promissory Note and Deed of Trust may be approved by the Development Services <br /> Director and shall not require further approval of City Council. <br /> 2 <br />
