which may hereafter be, imposed by the federal Department of Housing and Urban <br /> Development for the CDBG Program. <br /> SECTION 4.10 COMPLIANCE WITH FEDERAL LAWS <br /> Recipient agrees that it will comply with the Americans with Disabilities Act <br /> and Title VII of the Civil Rights Act of 1964, and that no person in the United States <br /> shall, on the grounds of race, creed, color, disability, sex, sexual orientation, national <br /> origin, age, religion, Vietnam era veteran's status, political affiliation, or any other <br /> non-merit factors be excluded from participation in, be denied the benefits of, or be <br /> subjected to discrimination under any program or activity funded in whole or in part <br /> with funds made available by City pursuant to this Agreement. <br /> SECTION 4.11 CONFLICT OF INTEREST <br /> Recipient shall not, during the term of this Agreement, without obtaining the written <br /> consent of City, permit any member of the governing board of the Recipient to <br /> perform for compensation any administrative or operational functions for the <br /> Recipient with respect to the performance of this Agreement (including, but not by <br /> way of limitation, fiscal, accounting, or bookkeeping functions.) <br /> SECTION 4.13 ANTI-DISCRIMINATION COVENANT <br /> In conjunction with performance of this Agreement, Recipient has been made <br /> cognizant of and will comply with, all applicable affirmative action, anti- <br /> discrimination and equal opportunity guidelines and requirements of the federal, <br /> state, or local government--Recipient will use its best efforts to utilize minority and <br /> female enterprises and ensure that minority and female-owned enterprises have equal <br /> opportunity to compete for subrecipient work under this contract. <br /> SECTION 4.14 DRUG-FREE WORKPLACE <br /> Recipient and Recipient's employees shall comply with City's policy of <br /> maintaining a drug-free work place. Neither Recipient nor Recipient's employees <br /> shall unlawfully manufacture, distribute, dispense, possess or use controlled <br /> substances, as defined in 21 U.S. Code Section 812, including marijuana, heroin, <br /> cocaine, and amphetamines, at any City facility or work site. Violation of this <br /> provision shall constitute a material breach of this Agreement. <br /> 8 <br />
