• 99315159 SECTION 1. - DEFINITIONS. Unless otherwise expressly provided herein or unless the context clearly requires otherwise, the following terms shall have the respective meaning set forth below for all purposes of this Regulatory Agreement: CITY: Means City of San Leandro, a municipal corporation, and its successors. DATE OF INITIAL OCCUPANCY: Means the date that the Project is first occupied by tenants following completion of construction. RECIPIENT: Means San Leandro Shelter for Women and Children, a nonprofit public benefit corporation, and its successors as approved by the City pursuant to the Loan Agreement. LOAN AGREEMENT: Means the Loan Agreement entered into between the Recipient and the City governing the use of Community Dtelopment Block Grant (CDBG) funds for the Project. PARTICIPATION IN THE PROJECT: Means that the City has invested a dollar amount of One Hundred Eighty Thousand Dollars ($180,000) in the Project. The amount of City participation may be increased at the sole discretion of the City. PROJECT OR PROPERTY: Shall mean the acquisition of property within the City of San Leandro to be used as a safe house for battered women and their children. SECTION 2. INTERPRETATION. Words importing any gender include all genders. Words importing person include firms, associations and corporations. Words importing the singular shall include the plural and vice versa. The terms "herein," "hereunder," "hereby," "hereto," "hereof," and any similar terms refer to this Agreement, the term "heretofore" means before the date of this Agreement, and the term "hereafter" means after the date of this Agreement. Articles and Sections mentioned by number only are the respective Articles and Sections of this Agreement so numbered. Reference to "this Article," "this Section," or "this subsection," shall refer to the particular Article, section or subsection in which such reference appears.
