Planning Commission Staff Report December 20, 2012 <br />PLN2012-00039 Page 7 of 8 <br />Landscaping <br /> <br />The landscape plan supplements the architectural plans with a comprehensive palette that complement s <br />the proposed residential project. The plan specifies tree sizes ranging from 24-inch box to 15 gallons. It <br />intends a pallet of plants with colorful flowers or colorful foliage, some turf and ground cover planting. <br />The shrubs will be five gallons to one gallon and the ground cover would be one-gallon or from flats <br />with the necessary spac ing to cover the planter areas in a growing season. Paved patio areas and <br />walkways are shown the plans. <br /> <br />Engineering Requirement <br /> <br />A condition of approval will be that prior to issuance of a Building Permit, a lot line adjustment shall be <br />submitted and processed through the San Leandro Engineering & Transportation Department for the <br />merger or combining of four parcels in to one parcel. <br /> <br />American Golf Corporation Comments <br /> <br />Being adjacent to the nine-hole executive golf course that is owned by the City and operated by <br />American Golf Corporation (ACG), the applicant is agreeable to addressing ACG’s comments <br />regarding the projected. <br /> <br />1. The applicant will disclose to future residents/tenants that they will be living very near the golf <br />course corporation yard which begins operations by 6:00 a.m. in the morning for scheduled <br />daily maintenance on the golf course. This disclosure requirement is similar to the one given to <br />potential resident s that will live next door or near Kraft General Foods (Halcyon and <br />Washington). They are made aware that the Kraft has late or early morning noises and traffic <br />which has occurred on the site prior to the residences. <br /> <br />2. In addition ACG recommends another disclosure that the residences will live next door to large <br />eucalyptus trees which can be very messy with its leaves, fruit and pollen. The area beneath the <br />eucalyptuses and adjacent to the proposed residential project will be left natural and <br />unmaintained. There should be no expectation by the residents that this area will be improved <br />in the future. <br /> <br />3. ACG requests that it has no liabilities (be indemnified) with regards to the new fence and <br />landscape treatment along the shared property line (i.e., maintenance or repair of the proposed <br />fence, damage by errant golf balls, etc.). <br /> <br />ENVIRONMENTAL ANALYSIS <br /> <br />This project is categorically exempt from the California Environmental Quality Act (CEQA) per CEQA <br />Guideline Article 19, Categorical Exemption, Section 15332 In-fill Development projects. <br />Furthermore, the rezoning is exempt from CEQA, per CEQA Guideline, Section 15061(b)(3), where it <br />can be seen with certainty that there is no possibility that the rezoning in question may have a <br />significant effect on the environment. <br /> <br />PUBLIC OUTREACH <br /> <br />Notices for the public hearing were mailed to the property owners within 300 feet of the subject <br />property and the Mulford Gardens Improvement Association and the Marina Action Committee
